Sponsoring parents, got laid off

my brother sent a sponsorship for parents and yesterday he got laid off from work, Am I right that he can apply for EI (employment insurance) and still continue with the sponsporship? Thanks for anyone who replies.

He can still continue with the parent sponsorship even while on EI as it is not considered social assistance. However that said, if the total 2014 income for 2014 drops below 2014 LICO requirement, it can jeopardize the sponsorship. The new rules states that the sponsor not only qualify the 3 previous tax years, he must also maintain yearly LICOs requirements during the entire Parent PR sponsorship until the parents land as PR.

So as long as your brother had a co-signer (wife) or picked up another job soon he should be okay. It is early in the year and he has 11 months to come up with the 2014 LICO requirement. So using 2012 LICO as a good indicator benchmark, he must have an income of at least 2012 LICO by the end of this year if not a little more.

Please reread my post. I revised my post again. I mentioned that it is early in the year and as long as he can pick up another job soon and still meet at least 2012 LICO by the end of the year, he should be okay.

No I don't think so.
If CIC wants to do a re-assessment of income, they will ask for new NOA/Option Cs at some point in the future. So hopefully he can find a new job quickly since if their 2014 income doesn't meet the future 2014 LICO amount (and I don't think EI received for being unemployed counts towards your income), then the app can be rejected out in 2016 or 2017 or whenever they want to do the check.

If I was in same situation as OP's brother, I wouldn't have bothered to inform CIC about it. No point in informing CIC about it only to find another job a week later. CIC does not need to know the circumstances of your employment. They are only interested in making sure you maintain future LICOs during the entire process and NOAs / Option C Printout will confirm whether you are maintaining your income or not.

This one of the reasons, the rules now require you to maintain LICO until your parents land. They don't want sponsors to get off the hook just because they submitted the application when they become unemployed, unintentionally or not (quitting your job) after the fact.

If the OP's brother managed to just barely meet each of the 3 year LICO's requirement, then that can seriously hurt his ability to maintain his 2014 LICO requirement. The longer he is unemployed the harder for him to get back to meeting the 2014 LICO requirement. If his job pays very well and it was well beyond the LICO's 3 years requirement, it would mean your brother has a bit of breathing room in finding a job and make up for it quickly before the end of the year.
