Sponsoring my Korean wife for permanent residency

Hey guys, I know its been a long time since I've written anything here but wanted some quick advice. I sent my application to sponsor my wife and it was received in October 2014 and I was approved for sponsorship and now I'm waiting. we moved to Canada with no issues shortly thereafter and bought a house and I got a job. A couple months ago I sent in an application to extend my wife's visitor permit which we got last month and it extends her stay till April 2015(hopefully she'll have her PR before then) and now she would like to visit her parents with a our 2 children(both have Canadian Passports) for a month this summer. She read on my Korean cafe that some other people were not allow re-entry into Canada, so she is worried that she might be denied re-entry with our Canadian/Korean kids when she comes back from Korea this summer. Do you guys think she will have an problems? Could customs really deny her re-entry?

Any advice would be appreciated. Im thinking I'll give her a notarized letter from me giving her permission to take the kids for a visit with a copy of my passport, sponsorship approval letter and of course her visitor permit good till next april.

Cheers

Jason

The first thing to remember is that if she leaves Canada for Korea, her April 2015 extension is no longer valid and, when she returns, she'll be back to a six months visitor's visa. If you need to extend that, you'll have to apply for another extension.

There are never any guarantees that she'll be allowed to re-enter the country, though being from a visa exempt country, having Canadian children, a PR application in process, with a Canadian husband with the means to support her and a place to live will certainly help. Will she and the kids have return tickets to Korea when she comes back?

CBSA can always deny her re-entry if they suspect she won't return home, so no matter how you do it, there's always a chance she'll be refused. You're rolling the dice to some degree.

It would be much wiser to stay here. Any chance you can bring the parents here instead?

The kids won't have return tickets to Korea, just back to Canada, my wife will of course have a return back to Korea for when her visitor permit expires next April. Can't bring her parents here:(

3 Questions for you helpful folks :D :

1. "Certificate of Entry and Exit issued by Korean Immigration Services" has been requested. Do you know the Korean 한글 translation for that?

Will I need to get that document translated into English?

2. I will be visiting Canada next month, and then returning to Korea (until we move later in the year). Is it possible to get a BC drivers license without giving up my Korean license?

Like I said. It's a gamble. With a return ticket and all the other factors I mentioned, she'll probably be okay. Make sure she has her UCI number handy when she re-enters and tells the CBSA officer that she has a PR application in process. As always, she needs to emphasize that she is just coming to 'visit' and not to 'live' here.

The only thing that would concern me is the fact that, on returning, her story will essentially be that she is coming to visit her husband in Canada with her two children and, if necessary, will leave Canada after six months without her children. I think most CBSA officers will understand her situation, but you may get one who just doesn't believe that a mother would leave her kids like that?

I don't know the Korean translation but you can get it at any local government office or at an immigration office. Someone in this thread said a long time ago that you can also get it online but I don't have the link handy.

Will I need to get that document translated into English?
Probably not. The one my wife got was written in Korean and English.

2. I will be visiting Canada next month, and then returning to Korea (until we move later in the year). Is it possible to get a BC drivers license without giving up my Korean license?
Ontario guy here, Sorry, can't help you with that one.

Thanks Bart. I found it on page 17 of this thread. It's titled "출입국 사실증명", and available here:

I am filling out visitor form and have question regarding to available fund.

My husband support me and i may not have enough fund to stay in Canada.
So Can I send photocopy of my husband bank balance or CIC would not care how much I have now since my husband has full time job.
I also send photocopy of his pay stub.

One more question, my permit will be expired end of May, if I send extension form now, would it be too late ?

Thank you in advance.

Yes, send a copy of your bank statement, explain that your husband works full time and supports you and tell them how much he earns. If you want to send a pay stub that's good too.

You have to submit the application before your current visa expires. Use a courier like Fedex or UPS or some service that provides proof of delivery. Make sure it arrives in Vegerevelle before the date your current visa expires.

Hopefully, but I think it is wrong that they aren't extending it.

Probably just means your first one expired.

CanNZ said:

Agreed. If they can't process the application in one year it makes no sense to have the medicals expire in that time.

Yea, the first medical expired 2 weeks ago meaning we have passed the 1 year in-process mark! I'm sure I saw posts somewhere about people getting extensions for the first medical vs a new medical. Well, this means my wife getting a day off work, medical fees, and a trip to Seoul AGAIN! What racket!

Tell me about it, what a joke. My wife's re-medical cost $285 plus another $150 for a useless follow up exam.

When I submitted the application I didn't due a medical for my wife, I just noted "will do when requested". Now they requested it (along with Appendix A, a Korean Entry and Exit Certificate, and 3 photos). So it seems to have been no problem waiting until requested.
