Hi everyone,

As of the end of this month my boyfriend and I will be common law. I am a Canadian citizen and my boyfriend is from the UK. We currently reside in the UK as I am on a working holiday visa. Our plan is to apply for the common law sponsorship. I have read the ins and outs and have all our documents gathered and ready to submit. If he gets a visitor visa to Canada could we apply inland and receive an open work permit? Thanks ahead of time.

If he is from the UK and is British, he does not need a visa to visit Canada, only an ETA. You can then apply once there as inland with an OWP at the same time. He will have to remain a visitor until OWP is issued (about 4 months).

Thank you so much! I’m not sure if you could answer this as well. How do we go about explaining it to the guard/customs? Should we purchase a return ticket? Thanks again for the help, greatly appreciated

What is his country of nationality? Is he a Brit?

It is very important that if he comes to Canada with you, that he is VISITING. So he will need all the things associated with a VISIT. A return ticket, strong ongoing ties back in the UK (house / flat / rental), belonging associated with a visit (i.e. definitely NOT all his worldly goods!). Of course as a visitor, he will not be able to work in Canada.

Do NOT lie to CBSA, but equally, no need to do anything other than answer the questions.

He is visiting for a few months and presumably staying with you. He will need to show he has enough money or means of support for the duration of the visit. Likely as not, he will get the automatic six months duration, which can be easily extended on-line if necessary towards the end of that time.

I think you will find that link and the further links in it invaluable - helped me a huge amount when I did outland sponsorship for my wife a couple of years back. Best of luck!
