so essentially my friend is opening up a business

she's wondering if she could sponsor her friend by hiring her as an employee while she's in Canada on a tourist visa or does her friend have to go back to Korea and then start the process ? who would initiate the process in that case ? the employer or the person in Korea who wants to get sponsored ?

her friend is over 30 if that matters

She (the person opening up the business) needs to obtain an approved LMIA in order for her friend to qualify for a work permit. The LMIA process typically takes 4-6 months to complete and requires the employer to advertise the job for at least a month to prove no Canadian could be hired for the role. It's a relatively complex and expensive process with no guarantee of approval.

If the LMIA is approved, the friend can apply for a work permit. She can do this either from within Canada or outside of Canada. The chances of approval are generally higher if she is outside of Canada at the time she applies.

Probably not that much. The fee is $1000. The employer will most likely also have to pay advertising costs as well.

Keep in mind that even with all of this money spent, there's no guarantee the LMIA will be approved.

that is fine ...$1k isn't too much for them to be frank but the LMiA might provide difficult ..I mean she's opening up a bar catering to Koreans and plans to hire her as manager of some sort...I'm not sure how stringent the govt is with the LMIA

The government is quite stringent about LMIAs. As said above, the employer must prove no Canadian could be found for the role. I think it will likely be difficult to get an LMIA approved for the job you've described. However the employer can certainly try.

actually ..do u know what the difference is betweem what I'm proposing and what I read on the media where students and foreign nationals are paying employers (eg subway sandwich restaurant owners ) to help them get a PR....doesn't the employer need to do the LMIA in the latter case as well ?

It's not easier to get an LMIA in these cases.

International students qualify for an open work permit after they complete their studies. They can use this work permit to work for any employer. No LMIA is required in these cases.

Generally they would need an LMIA and job offer so that they qualify for a closed work permit. There are some limited situations where an LMIA is not required. This includes situations where that person's spouse is already in Canada on a work permit and has a skilled job - or their spouse is in Canada as an international student. There are also IEC / working holiday visa programs for some countries where younger individuals can go in a lottery to get an open work permit.

sorry the reason I'm asking is ive heard from students working for this certain bar owner that he'll sponsor his employees ... I assume no LMIA is required as he only hires people with work permits .and *I think* all the ones are students who graduated
