Hi everyone,

I hope this hasn't been asked already but I have been searching for a while and couldnt find any advice.

The situation is:

I recently got my PR and I am hoping to sponsor my wife who lives in Canada on a study permit and my child who lives with his mom in Jamaica. Is it possible to apply for both persons at the same time?

The legal definition of a dependent child is a biological or adopted child. You could attempt to try one application for both of them but there is a very good chance of it being returned to you because your child does not legally qualify as a dependent of your wife.

You can submit separate applications for them at the same time.
 
Relationship between a parent and a dependent child
A dependent child is either a biological child or an adopted child of a parent [R2(a)]. The term “biological child” has been interpreted to include children in any one of the following situations:
  • was born to the parent making the application
  • is not genetically related to the parent making the application, but was born to the person who, at the time of the birth of the child, was that parent's spouse, common-law partner or conjugal partner
  • was born through the application of assisted human reproduction technologies
To avoid any confusion and issues with your sponsorship......better you submit separate applications for them at the same time.....i.e, spousal sponsorship and dependent child sponsorship.

Ask your wife to not forget to include your child as her step child in IMM5406 form

If you only recently got PR status, were either of your wife or child included in your application?
If not, were you married to your wife or was your child born before you "landed" as a Permanent Resident?

I'm detecting a possible 117(9)(d) here...
