I am asking for a friend of my wife. Here is the situation.

They have a child 2 Y/O
He is the sponcor

They have applied for her PR and are waiting results . He has been on house arest and has recently been jailed for not complying with the house arest etc.

She would like to know if she can get a passport for her child in case she will be sent home.

The marrage is not in good shape due to his infidelety etc and she is scared he will try and send her back home and keep the the child here in Canada.

Any help would be appreciated. She is broke and scared and has no body to help her.

I assume the child is Canadian?

She needs her husband's permission to apply for a passport for the child. Her husband must sign the passport application.

She would also need her husband's permission to remove her child from Canada and take the child with her to her home country. She cannot do this without her husband's permission.

The passport application must be signed by both the child's mother and also father. The child's passport cannot be obtained without the father's signature.

They need to update IRCC on his change in situation, as being in jail almost certainly makes him ineligible to sponsor.

But if she update is like she telling them to destroy the file as they can wait and the marriage might work they have child too otherwise she will have to go home and the child will be sent to care center which is shit , plus how you know if his conviction is bad it can be minor conviction. I not suggest contacting cic now she also should work and feed her child until her husband back. As I see he never treated her bad plus is not his fault his past actions as he was taking care of family until he gone.

Tell your friend to calm down and support her husband and the child in this difficult situation not to think of running and collapse everything.
She should be thankful that he sponsored her first place it is obligation for him too and not easy process.

And if they don’t tell them, they have obtained the PR fraudulently and she risks loosing it anyway. One of the few conditions of spousal sponsorship is being able to support your spouse. Pretty hard to do when your in prison.

You don't usually get an ankle monitor for minor crimes and OP has already stated that the husband has cheated on her repeatedly so not sure why you keep on standing up for her husband. Last thing you should ever do is lie to immigration.

Some more information. The lady does not have PR the application has not been aproved also she does not have work permit so she is unable to work.

The crime in question was a home burlary that happened 3 years ago , he left the province to escape the charges however he moved back and was arrested and put on house arrest. Then he was arrested for not complying his house arrest. The incedent happend when he was 17 y/0 about 3 years ago.

Not informing IRCC is misrepresentation. It doesn't matter what the conviction is.

Please note that he was already in this house arrest during it and government already know everything they not need anyone to inform them if it was serious conviction they would send to them since long that he is not in situation to sponsor IRCC will not wait until someone tells them they get notified anyway from RCMP.

Has she considered going to court and filing for full custody? Not sure how all three of them are able to live if they can't work. Given he has been in trouble with the law for 3 years they should have indicated that in her PR application.

Do you have proof that he cheated or even convicted in big crime if he not want her he can easily withdraw the sponsorship and kick her out so easy , so please not appoint yourself as judge as even Law givers have more mercy than you , look at the situation as a human not as computer. Plus why you not consider that she want take the child and run while the father is not there so this gives idea she is the one with bad intentions.

Apparently not! They have placed him in prison and the spouse can’t work. Not a lot of mercy in that.

There isn’t a lot of room in a process for that. They follow specific procedures. Compassion isn’t always something that oozes from IRCC. Stating fact doesn’t necessarily equal to not caring or having any compassion.
