I hope you are well.

I am seeking your urgent advice regarding my son’s immigration status and our intention to travel outside Canada this summer. I submitted a spousal and dependent child sponsorship application approximately six months ago, and I have received confirmation of eligibility as a sponsor. My wife has also received her open work permit. We were informed two months ago that nothing further is required from our side at this time, as the biometrics instruction letter has not yet been issued despite asking for biometric payment.

My main concern is my 5-year-old son. He holds a visitor visa valid until November 2026; however, he has remained in Canada for approximately three years without extending his visitor status. As a result, he is currently out of status. We are considering traveling to our home country temporarily this summer and returning to Canada afterward.
I am aseeking advice on any legal solutions

Then hire a lawyer.

On the non-legal, forum based solution, I wouldnt leave until he receives his PR. There's the risk he will be refuted entry or banned for violating terms of his TRV. Why wouldn't you have kept his status up to date? Seems a bit negligent.

As already pointed out it is risky to leave given the length of being out of status unless your child is a PR

It was not negligent, to be honest my PR was expired and I had to wait until I fulfil the condition of time to renew PR. meanwhile I was afraid to apply for him. The processing time giving me 10 month.

Why not keeping that way? You mentioned previously that your wife didn't intend to leave Canada during the process!
