Returns not files and CCB stopped

Hello Friends,

Need your advice for a friend.

My friend stayed in Canada with family for close to 7 months in 2018 and they had to go back to their home country in December 2018 as his parent was ill. They wanted to come back in couple of months but could not as his father underwent coronary bypass surgery.
He never worked in Canada as he was still in search of job for that period of stay and his wife worked for 2 months. They received ccb while in Canada and were receiving the benefit even after moving to home country. Since they wanted to come back in two months they did not asked it to be stopped. Both of them missed to file their returns since they were not in Canada and the ccb stopped this July.Now they are planning to return next month before the schools start

His queries are
1. Will he be able to file his previous year returns (2018) now after reaching Canada this August or September or will he have to wait till Jan 2020 and file along with 2019 returns.

2.Since he did not file his returns, his ccb stopped this July at the start of the benefit year. Does he have to call CRA now or after reaching Canada and inform them of the situation for the ccb to start or will he have to wait till he files his taxes as ccb is based on income and tax returns

They can file the missing returns now.

Once they are back in Canada, they should contact CRA to discuss this situation. Given how long they have been outside of Canada, they will most likely have to repay the CBB they received from December 2018 to their return to Canada. They should have contacted CRA to stop payments when they realized they were going to be outside of Canada for more than 2 months.

Boggles my mind that people that people don’t consider that they may not be entitled to CCB when they leave the country. When their visit was extended they kept receiving the money and didn’t call CRA. Would mention that there will be a penalty added when they pay back.

Thank you scylla for the advice. They will have to rectify and pay back what they owe

I totally agree and they have to bear the penalty if there is any. Thank you
