Restoration Period Expiring Soon , LMIA in Process

Hi all

Posting for a close friend... His restoration period is expiring in 2 weeks and a new employer has applied for lmia and has requested for expedition... However, even the expedited lMIA will take upto 3 week , if the request is granted...

Any suggestions what to do in this case to stay in Canada? if the restoration for visitor is applied , and in the mean time he receives LMIA, can he apply for restoration as a worker... Then obviously he will be having two restoration application, Is this allowed?

Another question is, if he does gets LMIA after applying for restoration for visitor, and 90 days has passed, can restoration for work permit be sent ?

Once the 90 days is over - he cannot apply to restore his status.

He should file the application to restore his status to visitor. If the LMIA is approved, then once his visitor status is restored, the can apply for a new work permit.

@scylla Can a restoration application be sent with a lMIA # and explaining that LMIA is in process?

No. The LMIA needs to be already approved.
