I am currently in a very tricky situation. My Work visa expired January 14 and my boss was actually telling me he would apply for an LMO for me and another group of foreign workers he hired 2 years ago. He got all that started in December, so pretty late already since he didn't wanna do it to begin with. But he realised that he can't run his business well enough if all the foreign workers have to leave.
So he used a company to help him with all the paperwork since he has no idea what he is doing. I have been asking him many times if he heard anything new about our applications. It took him 3 months (!) to tell me, that he actually can't apply for an LMO for me specifically.
The reason: The LMOs he is applying for are for Non-skilled worker. Up till recently I thought I was one too, however it says on my work visa that I am a food service supervisor which apparently counts as a skilled worker (even though I'm not since I still earned less than 12 bucks an hour).
Now, I don't want to leave Canada, I am actually married to a Canadian and the reason why I didn't do anything sooner is simply because I was relying too much on that LMO and I terribly regret that now.
I have mailed my application to restore my visa/change conditions about 1 week ago.
Now my question is how are the odds that they will approve?
I enclosed copies of my and his passport, marriage certificate, proof of support (my husband's paycheck), copy of my expired visa, receipt etc
I wrote down on the application pretty much what I was telling above, the reason why my visa expired and I also mentioned that I am planning to apply for PR.
I will still work on my PR while Im waiting for an answer but what else can I do in case they reject my application of restoring my visa?
Would it be possible to apply for a visitor Visa through my mother in Germany?
How else can I obtain legal status with my current situation?
Any advise what I can do? I am running out of options :-[
