Hi,
I desperately need some answers if anyone can help.
My husband came to Canada in October 2017 on a visitor Visa from Israel. We met and got married in March 2019. He has applied for a visitor Visa extension 3 times now. We just got the response back from his 3rd extension (applied for in April 2019) and he was refused. We were planning on submitting his Permanent Residency application as soon as possible as he would then be in Canada on implied status awaiting a response whether he got approved or refused. Unfortunately money issues and other problems came up that made us delay submitting the PR application. We were waiting until we got the funds for it. His refusal letter came yesterday and it says he has to leave immediately. We need to know how he can stay in Camada now. Whatever it takes. We are thinking of applying for a Restoartion of Status and explain that we just need a little more time to submit the PR application. Or even just to stall enough to get the PR application submitted. My main question is: if we submit the Restoration of Status application and submit the PR application while we are waiting for the answer, will he still be able to stay in Canada on implied status until we get the answer regarding his PR? What happens if he gets denied? How long can he stay then? I know we have 90 days to submit a restoration of status application; does that mean he can technically stay in Canada for another 90 days before he has to "leave immediately"? We can submit the PR application as soon as we get his police record as we now just have the funds. Please, any help at all would mean so much to me. If he has to leave then I will go back with him to Israel but I do not want to leave everything here behind. We need an answer. Anything. Please.
THANK YOU
