A family was on Work Permit With the main applicant & spouse on WP and two dependent children on Study Permits.

They applied for extension as a family under the primary applicant. At that time both children were under 22 years of age.

Extension was refused to the primary applicant, and consequently, refused for spouse and children as they were dependents. Now one child is above 22 years of age.

The family wants to apply for Study Permits and Restoration of Staus from within Canada for the two children independent of the primary applicant.

Question:
1. Do they create seperate GCkey accounts for the children and submit their SP & Restoration applications individually?

OR

2. Does the primary applicant has to submit his Restoration application from his own account and include the family members in it?
( The IRCC portal does not allow to create seperate applications. It only allows the primary to create the Restoration application and may include the family in it but does not allow for creating individual restore application for each family member)

I am unable to get any clear direction reading through IRCC documentation.

Posting under moving from Canada to the US so are they US citizens?

1. Is this secondary or post secondary? How old are kids?
2. Are parents still on work permits?
3. When did their study permits expire?
4. When refused were they told to leave Canada?


So to answer your questions without knowing any details it is separate CGKey accounts with funds/cash meeting proof of fund requirements. Again don't know if they can even restore status.

2. No. The father was the primary applicant. When his WP extension was refused, both the children SP were refused as both were dependents of the father.

1. So they are no longer studying and need to restore status and reapply for a study permit. They need PAL and show proof of fund each for $21k plus tuition.
2. They each have their own GC Key and account.
4. They can restore status but cannot study until permit is approved. They should show ties to return home and career opportunities at home.

Processing inside Canada is 9 weeks or look at processing from their country if IRCC decides to process Outland. Most likely not eligible for PGWP if study permit was refused so show strong ties to return home.

There is a person on the forum with the same issues so ask the question on the thread below. This person has the same questions as you and were told to leave immediately. Children got study permit based on parent's work permit and now are no longer dependants with new study eprmit.

They are not studying.
The regulations give a 90 day window for Restoration of Staus from the date of refusal. While applying for this they can remain in Canada. That why the family is applying for this and need that proper guidance to submit the Restoration application.

2. Each show $21k cash plus tuition (paid or in cash) with bank statements at least 4 months
3. Justify studying with showing career opportunities when they return home. Given that they had to stop studies (assuming) then probably not eligible for PGWP.
4. Given timelines will most likely not get a response until 2026 so cannot start Winter semester. Maybe Spring semester.

Can you refer any consultant who can do this by looking at all the angles rather than that person doing it himself?

You need a lawyer not a consultant if they have been ordered to leave, now have no status, refused permits and cannot study until approved. Post in this thread unless you are the same person and created a new account since stories are similar.

Yes, created a new account as the email for the last one developed issues.

The family (especially the rest of the family) should really be planning to return home permanently.
