Renewing my PR Card at last

Hello Experts,

I am starting to prepare my application kit for PR card renewal. I just like to double check if I'm updated with the requirements/law but first here's my history.

Landed immigrant Feb 2008
Left Canada July 2008
Re-entered Canada June 25, 2012
PR Card Expired Mar 2013

Note: I've failed to meet my RO but was fortunate to be allowed to re-enter.

Now here's my understanding of the requirements, pls let me know if I'm right or wrong.

If I apply on Aug 1, 2014,

1) CIC will only look 5 years back from the date of application? In my case upto Aug 2, 2009?

2) Days outside Canada = not more than 1095 days? In my case 1058 days (Aug 2, 2009 to Aug 1, 2014)?

3) Days within Canada = 730 days or more? In my case 767 days (June 25, 2012 to Aug 1, 2014)

4) I pass all the requirements right?

5) Are there any or new requirements I'm missing?

1. If you've never left Canada since re-entry then your day count is good - its actually 768 as any day or part of a day counts as 1 day.

2. The problem most PR Card renewal applicants have is proving the 730, 767, 768 etc. days...the documentary evidence required shows CIC place value on your tax records which really means if you work full time you are usually ok if you don't they will usually dig into your application.

Yes I never left Canada since re-entry and yes I have a full time job from July 2012 upto present.

Please help.

I was filling up form no. IMM5444 (application for a permanent resident card) and came across some confusion about the 5 year back tracking or back dating.

The form is asking for dates of my residence and travel history outside Canada in the last 5 years. The form need the "FROM" and "TO" dates, now here are my questions

1) I left Canada 2008 and re-entered in June 2012, what "FROM" date should I write the time I was outside Canada? June 2009?

2) there's a check box asking for my consent for the CIC to collect history of my entries into Canada from CBSA, will they see that I entered 2008, exit 2008 and enter again in 2012, or will they just look back 5 years only (2009)

I'm worried that my application form and CBSA's data won't match and would lead to a bigger problem like deportation, etc. I already bought a house here.

Please help.

Write the "From" date as 2008 when you really left. Because they didn't catch you at the time that you did not meet the RO, they can now only look at the past 5 years.

Even if a person had resided away from Canada for many years, but returned to Canada and
resided there for a minimum of 730 days during the last five years, that person would comply with
the residency obligation and remain a permanent resident. An officer is not permitted to consider
just any five-year period in the applicant’s past, but must always assess the most recent five-year
period preceding the receipt of the application

Great. Thanks Leon. So this applies to address history, work history and travel history dates right?

Also I just noticed that in the travel history section of the form, I'm asked for the "Period to be Assessed", again the "FROM" and "TO" dates are being asked. So this time for the "FROM" date I will use the year 2009 right? and for the "TO" do I just leave it blank?

1. To = date you sign the application.

2. From = minus 5 years from date in 1.

In mailing my application I will use Canada post's EXPRESSPOST, is that regular mail or COURIER? the mailing addresses are different so I'm just confused.

To Leon and Msafiri,

Need your help again guys. Some confusion again :)

In the travel history section of the form, the period to be assessed in my case is from 2009 to 2014 (back track 5 years). then below that is the "FROM" and "TO" dates for my travel details outside canada. Here's my confusion,

1) for the "FROM" date, do I put 2009 also same as the date in the Period to be assessed? or

2) do I put the year 2008? this is the year I left canada, and I used that year also in the address and work history section. If I put 2008 then I will be outside canada for more than 1095 days, then I have to fill up section D "Residency Obligation"?

My understanding is the "FROM and "TO" dates for Period to be Assessed and details of travel history below it should be the same, right?

Just use the 5 year preceding your application date even if this cuts into your exits.

As an example - if you were outside Canada between 2008 and 2009 then have your from date as that 5 years prior even if this is in say mid 2009.
