Renewal Of PR - Require Help !!!

Hi, I did my landing in 2007 and havent completed my required stay in Canada due to my work commitment in another country. We have a child who is born Canadian and holds a Canadian Passport and the rest of the family have PR status valid till 2012. We are planning on quitting our jobs, and kids schooling etc and moving to Canada next year, 3-4 months before the the PR status gets invalid.

Kindly advise if I can be stopped at the airport and deported back or our PR would be revoked???

I really require the information as we will be giving up everything to become Can citizens.

No - you can't be stopped at the airport and deported.

However the immigration official at the airport could report you for failing to meet your residency obligation. If you are reported, you will have to appear in front of a judge who will decide if your PR status should be revoked.

You should try to return to Canada as soon as possible.

If you manage to re-enter Canada without being reported, you should then live in Canada (without leaving for even one day) until you have accumulated 730 days of residency over the last five years - and only then apply to have your PR cards renewed.

When u say PR card will be revoked- means can I stay in Canada after its revoked? or will I be deported? or what will be the situation???

as we have stayed in canada in 2008 for a couple of weeks & in 2009 for month and a half only and then returned back to our work place. When we entered in 2008 the IO wrote on our passports that we were away since 2007 (landing day) and when we entered in 2009 (as my wife was pregnant and deliverd in 2009 in Canada the IO wrote away since 2008.

as we didnt have help when we had a new born baby in 2009 and quite low on funds we decided to leave till our kid gets little older. now we are in a better state so would like to be back.

Would it be of any help, as our little kid is Canadian citizen holding a Canadian Passport???
What should I do now as I am planning on coming in 2012.

If your PR status is revoked, this means you no longer have status in Canada and must leave. If you do not leave, eventually this will turn into a deportation order.

Having a Canadian citizen child does not exempt you from the residency obligation. In other words, even if you have a child who is a Canadian citizen, you must still live in Canada 730 days out of every five years if you want to retain your PR status.

The best thing you can do is return to Canada as soon as possible and hope you are not reported by immigration officials for failing to meet your residency obligation. If you are not reported, then you should stay in Canada until you meet the 730 day residency requirement - and then apply to renew your PR status.
