Dear All/Asivad,

I am going to get an employment letter from my previous workplace. I need some help in below query.

Giving some detailed information
- I applied for the post-graduate work permit on 24-Feb-2015.
- My study permit was valid till 31-March-2015. From 1-April-2015, I was on implied status till 7-May-2015.
- But the date issue of PGWP is on 8-May-2015.

Actually, I started working part-time in this company from 6-Oct-2014 to 31-March-2015, during that time I was on the study permit. The same company in mid-March provided me a new contract from 1st-April-2015 to 08-Aug-2015. So I have two contracts issued by the company.
- First contract from 6-Oct-2014 to 31-March-2015 (Study permit and off-campus work permit)
- Second contract from 1st-April-2015 to 08-Aug-2015 (Post-graduate work permit)
- T4 issued by the company has one fiscal year information from Jan-2015 to Dec-2015, which covers both the contracts.

I am going to use my second contract in work history section to get points for my Candian experience and both the contracts in personal history sections. Correct me, If I am wrong.

For proof of work experience,
1) employment letter
2) pay slips for my entire period
3) T4 tax slips

Do I need to give anyone of the above documents or all the above for the proof of work experience?

Firstly, I believe your eligible under EE is valid if only you worked for 1 year as full-time employee. So I am not sure if your eligible with a contract job. And if you can somehow manage a letter with mentioning of full-time in your employment letter you need to submit all 3 documents (employment letter, pay slips and T4).

For contract job, the employer should specify number of hours you worked per week. It should be >= 30 hours to be considered as full time job. Also employer should specify your role/responsibility on the employment letter/reference letter (this is required for NOC verification).

I think CIC only considers 30 hours per week for full-time job and 15 hours per week for part-time employement. Correct me if I am wrong.

Full Time

30 hours/week for 12 months = 1 year full time (1,560 hours)

Part time

15 hours/week for 24 months = 1 year full time (1,560 hours)

Refrence : http://www.cic.gc.ca/english/immigrate/cec/apply-who.asp

Personally I would suggest you to wait till August to complete your 1 year full-time employment before you apply for EE (you've got lots of time left in your PGWP) but that's just my opinion other may differ.

40 weeks and 1440 hours does not meet the minimum requirement (52 weeks/12 months and 1560 hours), so you will have to wait to meet the requirement.

It doesn't matter to CIC if you work (full-time) 37.5 or 40 hours or even more they will still consider only 30 hours/week. So for your duration as full-time employee the number of hours that cic takes into consideration will be 30 hours per week * 33 weeks = 990 hours & part-time will be 15 hours/week * 13 weeks = 195 hours and your total hours that cic considers is 1180 hours only. As suggested earlier to be on safer side apply after completing 1 year (52 weeks & 1560 hours) of your full time employment i.e; your work beginning on 17-Aug -2015 to 17-Aug-2016. Hope I am clear with my explanation. Good luck.

Thanks Stanlee and Rohit.

During 8-May-2015 to 8-Aug-2015, I also worked on a full time contract as well. I didn't include it my work history section.

Job3: Company C (5months Personal Services Contract )
Status : Full time
Duration : 01-Mar-2015 to 31-July-2015.
Total weeks : 12 weeks (But PGWP issued on 8-May-2015. So I considered total weeks only from 8-May-2015 to 31-July-2015).
Hours/week : 37.5
Total hours : (12*30hrs=360)

1) Can I considered this contract job for 1 year CEC?
2) Is this contract considered as self-employed or not?
-They didn't deduct tax for this job. They asked me to file tax by myself.
-Contractor is not an employee in receipt of a pension. Work will be done off-site. But I worked onsite with client for 37.5 hours.
-Each and every month, I filled in the number of hours worked to get paid.
3) I have seen somewhere here in this forum, that self-employed job is not considered for CEC.

Full-time contract ? Never heard of it. As far as I know you can only claim points for work experience from the day your PGWP is issued. Don't rush and complicating things couple more months won't do you any harm.

"You can only qualify for EE if you have 1 year continuous full-time experience in the same NOC. Work experience gained while on study permit does not count towrds EE points"

For full-time work, hours are irrelevant. You simply count full-time weeks (any week where you work 30 or more hours ).

do you mean, I have to wait till July first week to complete my 1 year?

You need 52 FT/FTE weeks to have 1 year of experience. Based on the information you provided, you have 41 weeks (33 FT weeks + 8 FTE weeks), you need another 11 FT weeks before you qualify.

Keep in mind if you use part-time experience, it will ALWAYS take longer than one calendar year to qualify...

Sorry Rohit, In that contract job I worked for 37.5hrs every week. That's why I mentioned Full-time.

If I give 1 year of Canadian Experience, I am getting 483 points. As per the above discussion, I need to wait till mid-July to get 11 months of Full time and then I can use the 13 weeks of part-time work to get 1 year Canadian Experience. I am afraid that by mid July if the filtering score goes above 483 :(.

Currently, I am eligible to apply for PNP. Shall I wait for CEC or go ahead with PNP?

Which is sensible option, bcos my wife's PGWP is getting over on 10-Jan-2017?

Thanks Jes for explaining.

If I give 1 year of Canadian Experience in Express Entry profile, I am getting 483 points. As per the above discussion, I need to wait till mid-July to get 10 months of full time and then I can use the 1.5 months (8 FTE weeks) from job1 to get 1 year Canadian Experience. I am afraid that by mid July if the filtering score goes above 483 :(

Currently, I am eligible to apply for PNP. Shall I wait for CEC or go ahead with PNP?

your 1-year Canadian experience has to be after you graduate form university. The experience you got while on study permit/off campus work permit cannot be included in the 1-year requirement.
