Hello all,

I just got a refusal letter from the cic, stating basically that I do not meet the requirements.I have a job now for that I am still working at since 2014 but some how it shows on my profile that I stopped working in 2016 -11 .I had a part time job which they isnt counted(this is fine) but 3 other positions
Senior Analyst 2013-07 to 2014-06
Senior Admin 2014-09 to 2015-06
sys admin 2014-12 to present(which they have as 2016 ended)
My own business which I am a consultant in 2016 to present (which doesnt count)

I have been here over 10 years and went to school here , english is 8band and show more than sufficient funds, what should I do? They stated I had not provided sufficient evidence of the actions and duties I performed while working with the abovementioned employers.WHAT???? they didn't ask me to provide evidence. Now my work permit will be up in 4mths, can I get some advice please.

It's hard to give you any advice as we do not know what kind of duties/responsibilities were stated in your reference letters.
 
I'm sorry to hear this. It seems that your reference letter(s) didn't state your duties from your noc clearly enough.

In this instance I would create a new ee profile and wait for a new ita. Then improve the letters to better reflect your noc code duties.

It is unbelievable that you have lived in Canada for over 10 years so you are obviously very well adapted yet they are refusing you for dumb reasons. I mean how hard is it to request from you additional documents or call your employers to verify...
I wish you best of luck and don't lose hope!! create a new profile and try to get better reference letters.
 
Sorry to hear about your rejection.

They are issuing so many ITAs and have to process the applications within 6 months. Probably they want all the documents to be in order as per their requirements so that they don't spend time in verification or asking for more documents. It's easier to reject and keep the initial fees paid than to ask for more documents.

That's been the case from the start of ee. It's their "one touch" policy.
 
So is it worth it to appeal refusals or is it faster and safer to just create a new profile and start over?

There is nothing to be disappointed about. After you receive a rejection, you get 30 days to appeal it before the immigration court. If your experiences are all good, I would highly urge you to get in touch with a immigration lawyer. If you need a reference, let me know and I will be happy to introduce to one of my friends who is a leading lawyer.

In the past I have referred a few applicants who had refusals and their refusal was overturned. Also, in your case the IRCC will have to issue you GCMS notes within 7 days if you anticipate to appeal your refusal. There are also many other legal avenues that you can seek at this juncture.

I am very sorry to hear that. I am in the same boat as you are, having lived in Canada for more than 12 years and my current PR application being my last chance at staying in this country. Don't give up yet! I wish you luck on your next endeavor!

From what you wrote, it seems to me that your sys admin job should be the one considered toward your 1 year full time work experience requirement since the first 2 fall short of 12 months. Even if CIC assumed that your sys admin job was ended sometime in 2016, it would still be more that 1 year of work experience. Therefore, you should have passed the work experience requirement.

Now the only issue I can think of is the duties on your employment letter. Do the duties listed on your employment letter for sys admin match your NOC?

You don't state when you submitted your eAPR, but the "end date" could be the date of the ITA or the date on the top of the letter. Under the CEC class, no experience AFTER the application can be considered, and they need an "end date" to calculate the length of experience.

Wow, what? I am very sorry to hear about your refusal, but - of course they ask you to provide evidence, and warn you that if you don't, you will be refused. They tell you it is YOUR responsibility to provide a complete application, they simply do not have the time to chase after applicants for information that is required.

Did your letters of reference include job duties/responsibilities? Did you provide supporting documents (e.g. T4s, NOAs, etc...)? See proof of work experience...

It's hard to tell from your post what exactly the deficiency is, but you have enough time to submit a new profile and possibly submit a new eAPR and be eligible for a BOWP. Hopefully, you will get the help here that you need to succeed the 2nd time.

this is exactly what I am saying, but I think I you are right, I will create another profile and have my reference letters be more descriptive.

yes, that may be it, my reference letters just had that I worked , my salary, start and end date

Besides re-applying, there are 2 routes you can go.

One - if you believe that IRCC made an error (not you), then you can submit a CSE and request reconsideration, outlining the error that you believe IRCC made. If you provided all the required documents, your letters contained all the required details including job duties/responsibilities that were consistent with your NOC - you could do this. If the error/deficiency was yours, then this is a waste of time.

Two - if you believe that IRCC has made a decision that contravenes the law, then you can "appeal" - understand that this is a court case that will cost a lot more than simply re-applying. Also know that the courts have upheld IRCC's right to refuse applicants if they do not submit a complete application, or do not provide sufficient evidence to convince the VO of the claimed work experience.
