Hey,

I'm an international student residing in Canada from January 2006. I applied in July 2008 and got my AOR in January 2009.
I just received a letter saying I do not meet the immigration requirement due to insufficient points. I got 65 which lacks two points.
I've got 8 points from the language proficiency section, despite I claimed full 16 points. I kind of expected to receive an IELTS
request and not a refusal. Is there anything I can do about it?

Hi,

You need to re-apply and start all over again. It is imperative that you try to improve your English and get more points in IELTS, this is the only way you can get more points unless you find a blood relative all of a sudden in Canada which can give you extra points, but regardless of that, you will need to re-apply.
 
I tried to convince them but probably didn't do a good job!! I mentioned my two-year experience as a teacher/research assistant and
also got an official letter from my supervisor. I was just wondering why they didn't ask the IELTS?! Anyway, It just a hassle to start
over again especially the police certificates! Now I have one more year of job experience that covers the 2 points plus I'm gonna take
the damn test just to be on the safe side.

This is the Caution for all of those who are thinking to submit letters only instead of IELTS.
 
I hope everybody who has yet to submit their documents realize now that the IO will give you only 8 points for language if you dont submit IELTS.
if you can reach 67 with 8 points,you'll be ok. if you need the 16 points, take the IELTS, its not that bad.

So it is confirmed now that If you need 8 or less for language you can rely on written submission rather than IELTS??
 
I would not trust it. In the case of the OP, I think they should have asked him to take IELTS rather than just give him 8 points. Another visa officer might have done that. Another officer might have given him more points, another maybe less. In any case, I don't think you can just count on that they'll give you 8 points if you provide data.

Have you discussed your case with an immigration attorney liken Cohen?

Currently, I'm doing my Ph.D in Canada. I haven't discussed my case with any attorney. I thought the appeal chance is very slim, isn't it? also it could be very
costly.
