Hi everyone!

I have a question, I would appreciate any replies if you may know.
Could a person claim refugee after living 3 years in Canada? I cannot go back to my Country for some reasons, but just because I did not like to be refugee, I decided to study here and I wanted to apply for my PR after getting work permit and having Canadian experience to have enough points. Unfortunately I received refusals of my 2 applications to work here and I really have no idea why. Now I have to claim for refugee because I cannot go back to my country and I have enough reasons. Do you think if there is any chance for me to be approved as a refugee?

If you apply for refugee status, YOU WILL END YOUR CHANCES of having any visit/work/study visa to any country in the world & eventually you’ll be returning to your home country & staying there forever . I would suggest you to try another option to stay in Canada.

Unfortunately, you already weakened your case by failed attempts to get work permit. Its a big credibility issue. It shows you had no option left but to apply for refugee to stay in Canada.
You should’ve applied immediately after arriving here. Anyways, it’s better to try other options rather failed asylum. Which will close door forever.

What do you think about my chances to get another study permit for a higher education if I get admission from a university in another state? is there a high chance after these refusals?
 
Oh by the way Canada has Provinces not States; I'd think you would know that if you had been living here. In any case did you not sign the obligatory agreement when you arrived that YOU WOULD GO HOME at the end of your education? You can not get a job in Canada unless you have immigrated fully (a 2-5 year process costing about 60K) and have a SIN number. It is required for everything. In addition you need a LMIA (3K for your prospective employer to pay for the Government labour research) in order to work in Canada; companies won't even open your letter if you do not have the fundamentals. Remember also, this is a society with a 60% rate of having individuals with diplomas and degrees. You will have extreme competition from the locals and they don't need a LMIA. You will have to PROVE why you are worth 3K more than ANYONE else. We have no illegal's; they freeze solid. See, it really is hard to immigrate to Canada. There are no back doors. Also you would never get into another school with your overstay record. What happens is you are deported and get sent the bill.

yes, also I've heard some say state. And I think you did not get my question. Any international student in specified designated institutions have rights to apply for work permit after graduation. I did the same but was refused. And after my education I changed my visa from student to visitor and I'm legally staying in Canada until my visitor visa is valid. And without SIN number a person cannot do anything in Canada, you need it for almost everything, of course I have had it all the time living here. Yes I should leave Canada to somewhere else before my visa expires and apply for study permit outside the Canada. Thanks friend for your comment.

So you applied for a PGWP after studying? What were the refusal reasons?

What are the reasons you can't go back to your home country? 'Some reasons' is not a good explanation for anyone here to help you. If you apply to be a refugee now (after being here for 3 years), the visa officer will look at it like you are refugee shopping.
