Reactivate Permanent Residency

Dear Members,

Please help with the question below.

We were permanent residents of Canada. We left Canada couple of years ago and moved back due to personal needs. Our children were still minors when we left Canada. Our permanent resident card validity had expired due to not keeping up with minimum residency requirements. But permanent residency itself has not been surrendered.

It is our understanding that permanent residency status does not expire even if the card validity had expired. Children are now attaining 18 years of age and becoming major.

The question now is, can children reactivate permanent residency on their own and return to Canada if they wish to? They should not be paying for parents decision of leaving Canada.

How is reactivation possible? Approach local Canadian consulate for reactivation or enter Canada using expired card?

How long did you live in Canada after getting PR?

Your children would either fly to the US and re-enter Canada through the US / Canada land border using a private vehicle (if they have US visas) or they would apply for a PRTD with H&C considerations.

If it is only two years you left Canada your chances of approval is more in applying for PRTD for you and your family. Apply directly with good H&C reason.
