I'm a single (never married) gay dad from China which has a 6-month old surrogate child. I'm planning to apply for EE.
I've also asked some agencies, AI, and read lots of policies. There are some questions await the clarification.
Background:
Surrogacy is in the grey zone in China, and I got all the legal documents when I applied Hukou (registered permanent residence) for my son, like Birth Certificate, DNA Test between me and my son, A notarized document which claimed the custody of my son 100% belongs to me, and also the Shanghainese Hukou (registered permanent residence) where we are on the same booklet without the surrogate mon.
We have a notarized custody agreement stating:
Questions:
1. Should I list the surrogate mom as a spouse or a common-law partner? Actually we never knew each other before.
2. Should I declare at the first stage like 'my son is through a surrogacy arrangement' by LOE? Will it do any negative effects to the application?
3. If I choose my son as 'non-accompanying', is there still any possibility to be demanded to sign the 'IMM 5604' document? (Well, I still want let him to get the PR with me together)
4. Is there any expiration or validity of the 'IMM 5604' document?
5. If I can't contact the mom or the mom is not cooperative for the signature of IMM 5604, can I just explain the situation and hand in all the proofs to prove the surrogacy and the current situation of my son by LOE?
If there's anyone experienced whose situation like me and got the PR, I really need your help. Thanks again.

- child lives with me;
- I bear all child support costs;
- mother has limited visitation rights (1 time/year) and right to know basic information.
- No wording about immigration, passports, overseas residence, or sole guardianship.
