Hello,

I am a Canadian citizen and I am sponsoring my Japanese husband for permanent residence via inland application. We are both residing in Canada currently.

He has gotten an open work permit that would be valid until March 7th 2018 since his original passport expires on that date. Now he has a new passport that expires in 2028, so we will be submitting an application to extend his open work permit. However, now we only have a little over 2 weeks before the open work permit expires and he loses his status in Canada. We are planning to mail the application via express mail on Feb 19th so it should reach the IRCC in 2-3 business days.

My questions are:

1) I heard that my husband will get implied status once the IRCC "receives" the application. Does that mean the day our mail reaches the IRCC office? Or does the IRCC office have to have processed it in order to have it considered as "received"? How do we know that they have received our application?

2) Should we also submit an application for temporary resident visa extension via internet?

3) Worst case scenario, if the IRCC does not receive the application before the open work permit expires, can my husband leave Canada and then come back so he can get another 90 days visitor visa? (Japan is visa-exempt)

4) the application for extension requires a marriage certificate. Our marriage certificate is in Japanese and we have already submitted the certified translated copy the first time he applied for open work permit. Do we have to submit another one?

1) This starts from the day they receive the application at the office. You can tell they have received it by sending it with tracked shipping and checking the tracking.

2) No need, if you are applying to extend the OWP and they will receive it before his current OWP expires.

3) Better to apply online to extend his stay as a visitor rather than leaving Canada and trying to re-enter.

4) Yes you would need to submit it again, all of the same documentation is required the second time around unfortunately.

Hi KBH! Thank you for your fast response. You have saved me from a lot of anxiety and wasted time.

I have another question if that's alright. Would a translation of the marriage certificate suffice? Does it have to be a certified translation? I still have a translated copy without the translator's seal.
