Hello,

I have a question regarding my CEC profile. I came to Canada in 2020 september on study visa for 2 years undergrad diploma. My study visa got rejected back in 2019, and at that time I was in my 1st year doing my bachelor’s degree on side. I got my visa in june 2020 for september 2020 intake and I completed my 2nd year in July 2020 before coming to Canada. In 2021 I went back home in May for 2 months to give my Final year exams. My question is that my immigration consultant didn’t mentioned my ongoing bachelors degree at the time when he applied for my visa back in 2019 and 2020. Can I claim points for my bachelors now for PR because I have WES evaluation and everything for my bachelors ?

Where do we put ongoing study in study visa form ? I see under education section its asking for completed study but mine was not completed at that time ?

Mentioning that you were currently studying for a bachelors degree in your home country would have likely had a significant impact on your study permit application. Did you mention the bachelors degree in your PGWP application? Not mentioning the studies in your home country could lead to a finding of misrepresentation in your CEC application. I would suggest consulting an immigration lawyer.

So when I applied for study visa for undergraduate diploma I only did 1st year of Degree. Is also a issue if I didn’t mentioned incomplete study at that time ?

Given the fact that you were applying for a study permit not declaring that you were currently studying could easily be viewed as misrepresentation since the fact that you were currently studying would have likely had an impact on your Canadian study permit application. You can certainly argue that you hadn’t finished your course so didn’t realize you had to declare it. I assume you did declare your foreign studies on your PGWP application then?

Because it was applied through the immigration consultant and I am not sure if he did submitted my degree documents while applying for the visa.

If you also didn’t mention it when you applied for PGWP then you are asking to be found to have misrepresented your studies if you now claim the studies. You did not need ECA to declare your foreign studies on your PGWP application. I would suggest consulting a Canadian immigration lawyer but I would personally not claim points for your foreign degree. You are only declaring your studies likely because you need the points. You are responsible for everything submitted in an application even if you used a consultant.

Need to ask the consultant what was submitted since you signed it.
