Hi Guys,

Any help would be much appreciated on this query. I am the primary applicant for my EE PR application and i have all the documents ready, however there may be a problem with my wife PCC. My wife is also a dependent in my application and she came to canada at last week of April. Unfortunately her PCC was issued 6 days prior to her departure from India and moving to Canada. We have applied for new PCC from BLS here in canada but not sure how faster we will get, we just have 25 days to submit our application. Can i submit our application with her PCC from India and give a letter of explanation that we have applied for new one here in canada. I am hoping i would get new PCC by June 1st week.

What do you think would be the best possible solution for this approach? Thanks
 
yes submitting the current PCC issued in India and a letter of explanation would suffice for now.

Thank you so much! i am scared that the application may get rejected right away. Will provide letter of explanation along with BLS receipt as well. Hopefully will get the new PCC by June 1st week.

Yes, submitting BLS receipt as well as the completed application form (if you want) from PSK website would be a good idea.

If i were you, i would wait for the new PCC as long as i could.
And would submit the Old one with LOE only as last resort, lets say last 2 days of the submission date.

Got it. I am also planning to submit just 3-4 days before the deadline. Will wait for as long as i could. But it looks unlikely that she will get her PCC before the June 1st week. I am hoping IRCC considers as my case i am attaching her old PCC which was issued on April 17th 2023 and also letter of explanation regarding her travel and new PCC receipt too.

I second this opinion. @krishislegend - talk to an RCIC, you can speak to one in a day or two for an hour and get the best course of action. PCC is a hard rejection. Don't play around with whattaboutery of comments. Unless someone like Legalfalcon or Naturgrl say that it is alright to attach an LOE - I won't buy the opinion.

As per IRCC:

In exceptional circumstances, IRCC may accept both of the following:

  • proof of having requested a police certificate for some countries; and
  • an explanation of best efforts (not a guarantee of acceptance)
    • In this explanation, the applicant should explain the delay in a document and upload the document in the country-specific field. The uploaded document must show that the applicant requested a police certificate as soon as possible after receiving their invitation to apply.
If you are unable to obtain a PCC before the submission date, you can submit the application with a LoE, explaining how long it would take to obtain the PCC, proof of applying for the PCC, and the old PCC that you have, and why it does not meet the requirement anymore.

As long as you have the above, IRCC will not reject your application at R10. As soon as you obtain the PCC, submit it via web form.

Make sure you include receipts, web screenshots etc. in your proof of applying.
