Hi there. I am having much trouble getting clarity. I'm not sure who to ask and which "immigration lawyer" to trust. So here I am...at your mercy. :)

I am a Canadian citizen living permanently in the UK. I want to sponsor my partner and her two children (14 and 17) for all of us to move to Canada asap. The childrens dad has very little do do with them but refuses to give permission to move them. Their mother has sole PR. I believe, under UK law, legal orders in this regard can not be made for children aged 16 or over. We want to move in summer 2018 when the 14 year old will be 3 months shy of her 16th birthday.

What is the minimum requirement of Immigration Canada to allow moving both kids?
If not this forum, who should I be asking about this?
Any other advice?

Hi Brian,
I admit that I am not overly knowledgeable regarding this particular matter, but I do know that CIC (or IRCC) takes these things extremely seriously. They will want permission from the father for sure and if he refuses to give permission, it will be a big headache. It will make life much much much easier, in regards to sponsorship, if she can somehow convince the father to give his permission.

By PR, you mean Parental Responsibility, right? So, sole custody (here). We use PR around here to describe Permanent Residency.

I have not done this, so I am only going on vague memory. Of course, I will defer to anyone who has done this. To move dependants, you have to have either cut all parental ties from the other (ex)parent, and/or an order from the court. Does your partner and her ex talk still? might be easiest just to get him to sign the consent. If not, then you can try filing, and include the court order that states she has full parental responsibility. If CIC wants more, they can direct you accordingly.
