Hi.. So the CIC website is a bit confusing...
When my boyfriend and I apply for conjugal partners... how does it all work? I know that I first have to send off my sponsorship application and then once it's approved then we can send off his application. What do I send with my application? Do I send my application as well as his at the same time? He's 11,000km away so it's not easy for us to do all the applications unless we send it all back and forth but that will be so time consuming. It would be easier if I did mine by myself and he did his by himself. What about all of our proof such as pictures, hotel receipts with our names, plane tickets etc.? Any links would also be very helpful! Thank you!

Also it asks for marital status and questions to do with common-law, we do not want to write "single" because we are not, so do we write "common-law" seeing as there's no conjugal or "taken" status...?

:D ;D :) ;) 8) :-*

You must send both parts of the application together / at the same time. The entire package must be mailed to the Mississauga office. If you only send your half first, then the application will be returned to you unprocessed since it's incomplete.

I would advise you type "conjugal" in the search box and read many of the threads. Conjugal is the hardest to prove with a low approval rate. As another poster mentioned, if you're able to get married in a third country, the VO may reject your application even if you can't get married in Canada or his home country.

He's coming here in February for a few weeks to see me but if you look at my other posts.. he's worried that my name will need to be on his Indian documents because all Indian documents like his passport requires his spouses name but he cannot have his parents see it.

We are gay so I think we wont have such a hard time with the conjugal partners... right?

If he is coming to Canada in February to see you, then you should get married and then file the application.

The conjugal class is for those who cannot get married and cannot live together. You don't face these barriers since you can get married when he's in Canada.

The fact that you and your partner are gay does not autmatically mean you can apply through conjugal. To be accepted under conjugal, you still have to prove it is impossible for you to live together or get married. It's not impossible for you which means there's a good chance your application could be refused if you file as conjugal.

If you are serious about this relationship and about sponsoring your partner - get married when he's here.

I would urge you to consider your options carefully. They might (and have done so in the past) refuse cases similar to yours. They need to see a valid legal barrier to get married. If you can't demonstrate that, and if you don't qualify for either CL or as a spouse, then the approval chances are rather low. Take a look at the case in the following link:

http://canlii.org/eliisa/highlight.do?text=conjugal+sponsorship&language=en&searchTitle=Search+all+CanLII+Databases&path=/en/ca/irb/doc/2006/2006canlii52352/2006canlii52352.html

Best wishes.

Whether or not his parents approve, is NOT a suitable reason. To prove conjugal one step you need to do is show your partner was refused for immigration to come to Canada which presents a legal barrier. Since he is actually coming here in February, this would hurt your case as there is nothing stopping you from getting married here, or in some other country. You yourself could also travel to India and live together there for 1 year to establish a common-law relationship (again simply inconvenience or family approval is not a suitable reason). There are numerous ways you could do a common-law/married application... so unfortunately your conjugal application will most likely be refused.

The comment was made about spousal names showing up on Indian passports... would this also be the case for same-sex couples, if India doesn't recognise gay marriage? (Just posing the question, I'm not sure but am just wondering - if India doesn't recognise it then I can't see them requiring to have the spouse's last name on the passport?)

I was wondering this as well. The visa officer may not accept your reason for not wanting to get married if there is no need to put a same-sex spouse's name on the passport, since such a relationship is not recognized in India.
I also agree with the other posters - get married while he is in Canada. Conjugal won't work, probably.

you dont need to get married.....after all....they say......dont get married for Immigration purposes.

Your boyfriend can ask to extend his stay here or you can do a combination of 6 months in Canada and 6 months in India for example and then apply for common law

Besides, getting married is not a ticket to Canada anyway. They will look at the possibility of MOC (marriage of convenience)

You need to understand that there was (and is) lots of immigration fraud.

I am new member here and hopeful to get an advice from you guys who has the knowledge with regards to the conjugal partner sponsorship.

My relationship with my Canadian boyfriend started March 2011 through internet. My boyfriend was a married Filipino citizen before migrating to Canada and became Canadian citizen. He filed a divorce and got the certificate last month.

I am from Philippines and currently working here in Bahrain for a couple of years already. We started our relationship March 2011 and decided to meet each other in the Philippines last November 2011 to meet each others families as well. We stayed together for almost one month there. He went back to Canada to work and i went back to Bahrain for my work. Our communication from day 1 of our relationship is unbelievable, everyday we talked through skype, i should say every 12 hours we talk, long distance relationship now a days is not so hard when it comes to ways of communication but it is freaking hard because couples are really far from each other.

We both want to be together, and we both agree it is better to start our lives together in Canada as he is giving financial child support to his daughter. My boyfriend came to visit me twice last year and stayed together for less than a month.

Are we as a couple be a strong candidate to be in conjugal category?
Can someone with experience and knowledge help me out in what the best steps/method for us to be together?

Thank you

Do you have any legal barriers to get married? he is divorced, and nowhere in your post you say that you are married.
If you're not married, or you're divorced, then get married ( In canada, or anywhere else, probably the philippines is not an option because there is no divorce there), and then applied as married.
To be in the conjugal category you have to prove that you can not get married, anywhere.
