Hi I would like to get an advise. I live in Ontario and a canadian citizen my problem is my girlfriend is a contract worker in Alberta for 2 years. She is now more than 1 year in Alberta. Recently she got pregnant and now on her 10 weeks. I am not yet divorce from my previous relationship and I am here to help her settle in Canada. What should she do to get a pr after she get birth. What would be her status after she get birth since her contract will expire on September and she is due on August? What would be the status of the baby since father is a canadian citizen and acknowledge the responsibility of taking care of the baby?
 
If she's not a low skilled, she can extend her work permit or apply for PR through PNP or CEC.

If she is a low skilled, it's a bit more tricky, she will have to leave after her 2 year contract for 4 months before she can apply for another low skill permit unless she can get promoted to a skilled or if she can apply for PR through PNP as a low skilled in AB.

If she can't do either of those, she could apply to change her conditions to a visitor when her work permit expires. Since the change of conditions takes something like 80 days to process, it would buy her time of implied status while she waits for an answer, even if they say no. They might be nice because at that time, she will have just had a baby and maybe not so good to travel. Possibly at that time your divorce will be final and you would be able to marry her and apply for her sponsorship.
 
Thanks leon for your reply. One more thing how about our baby how can arrange the papers . Can I apply her for permanent residence since she will be born here and I am a Canadian Citizen? To add to my girlfriend she works in the hotel in Alberta can't she not just apply as pr. I don't know how long my divorce will be but for the time it take she might be out of contract and I don't want her to go back.
 
Any baby born in Canada is automatically a Canadian citizen unless the parents are diplomats. If the girlfriend is working in a hotel, if she is a room attendant or a front desk clerk or a food server, she can ask the employer to do PNP for her. See AB semi skilled program at http://www.albertacanada.com/immigration/immigrate/hotelandlodging.html She should try to apply as soon as possible to have more chances of getting PR before her contract is up. If her contract ends and she's applied for PR and is waiting, she should call AINP for instructions but I think instead of going home at that point, she should apply to change her status because that will buy her more time as she waits for PR. She could apply for an open work permit based on that she is waiting for PR.
