i got this email yesterday from Buffalo office because of i am asking them about my application status it was almost 9 mon with out any progress their answer surprise me.

Changes to immigration law in 2008 allow us to set, through ministerial instructions, the number and type of applications considered for processing each year, and the order in which these applications will be processed.

Under the first set of instructions we used our new authority under immigration law to control the type of applications received, but not the number. We learned that wasn't sufficient. With so much competition and interest in immigrating to Canada, applicants, and sometimes consultants, look for ways to fit applications into the eligibility criteria in effect at the time. Therefore, before we introduced a cap on the federal skilled worker program as part of the second set of ministerial instructions, the number of applications we received exceeded our ability to process them in a timely way.

* We are committed to reducing processing times. With the introduction of the cap under the second set of instructions, we have limited the intake of new federal skilled worker applications to better match the number we can actually process within the annual levels plan tabled in Parliament.

Our goal is to make the immigration system more responsive to labour market needs. By prioritizing federal skilled worker applications received on or after June 26, 2010, we are responding to the most urgent labour market needs first.

Because they reflect Canada's current labour market needs, federal skilled worker applications under this most recent set of ministerial instructions are processed on a priority basis - within 12 months of receipt. For example, the first person to receive a decision under the second set of instructions did so within three months.
*
The length of time it takes to finalize an application varies from one visa office to another since visa offices face different challenges operating in different countries, regions and even in different offices within the same region.

The number of application varies from one visa office to the other. While Buffalo, London, New Delhi received more application, others receive less.
The processing of application depend on the visa office. No need to worry. IT will soon get to your turn
 
What a bummer...We have no option but to wait at their mercy..Is there a way to submit a collective representation to the Immigration Minister that we all have spent considerable amount of time, effort and money, applying under Feb 2008 Ministrial Instructions wherein the Minister made a statement to complete the PR process in 6-12 months. This delay due to their poor planning has put some crucial decisions of our lives on hold.

"collective representation", that is a good ideas.

If we can join up with hundreds of applicants prior to Jun 26th to complain to CIC together maybe that could lead to positive things. :)

Yes, i think if we do that the better, the problem is we are scattered in different visa offices. So my problem is, how it can be done. yes, the made us a written promised and they have failed to keep to their promise and have not even explained to us in a good way when they will process our applications. They keep sending annoying e.mails to us. We are human and also have a heart to get angry or to be happy depending on the situation. They really treat us like we are desperate, no not at all.

Life will still continue outside of Canada and even better.
lets wait and see what to do.
 
i definitely agree with the "COLLECTIVE REPRESENTATION".... it should embody all applications, pre Feb 2008 and post feb 2008, and who knows, even the post June 26, 2010 (with the coming NEW MI in July 2011).

it's hard to put in words the indignation i feel right now. sometimes it makes me think, do we really have the right to feel cheated? it's not like we don't have a choice. we do have a choice. but, did we really blindly choose to be cheated and treated this way in the hope that we can find a better life? Is this really the price we have to pay for wanting something good? It's like an invitation to a grand event. Wherein you feel so privileged to have been invited. surely u know u have got the right tools in your tool box to be considered. so u gathered all your efforts and resources to be more presentable. u came in armed with your best only to be tossed and/or made to wait in vain. This may be because the host is stupid enough or not soooo mindful that the invitations sent out exceeded their capacity. Whew! tough luck! my bad, this invitation isn’t free.

I hope, someone out there will see our sentiments and be able to help us. i mean... this situation should not go on….there’s money involve here. like what I read in one of the posts…they are earning billions from us.
 
I am sure there are enough IT techies here on the forum. Please come up with an idea to make and send the "COLLECTIVE REPRESENTATION" from pre-June 2010 applicants spread all over the world to the Immigration Minister like is there a way to create a letter on the web where we all can input our details and send it to the Minister.

I really fully agree with u. We can do something for sure. There is a couple i saw in a video about the immigration to Canada and they were complaining and sued the Federal government for lying in their immigration promises and finally they were give a job. If they did not raise their voice, they would not have been offered the chance to work in their field. So sometimes , it is good to raise your voice.

In this our situation, if they were able to write to the applicants politely and make us a new date or processing time for our applications, it would not have been a problem. But the way, they treat us is very bad and the responses make feel like going mad. After all the money you have spent and the time , you have waited. Life is about planning, if you fail to make your plans carefully you can not succeed in life. They are wasting our time, that we would have used to plan our life.

Waiting for others to make proposals and we look for the way forward. Ready to follow what has been agreed.

We have to agree to what has to be done and how to do it.

Waiting then.

Yes, i agree with you. We can make this Collective representation. I do not even know, if they know what it means by a written commitment? If something is written , it means it is binding. But to the immigration minister it means nothing. Sure they do not know the effects of what they are doing to the applicants.

lets do something i am ready to sign or participate in any decision taken.

Immigration is our privilege not our right !!
CIC is at liberty to change laws anytime to suit their needs & demands. It does not work on sentiments!
The fact that we are atleast in the queue to get a Visa some day is a big bonus to us.
The rules for immigration from July 2011 & every year thereafter are going to get more strict & difficult to qualify.
 
PRIVILEGE:
“a RIGHT!, immunity, or benefit enjoyed by a person beyond the advantages of most…..”
“a grant to an individual, corporation, etc., of a special RIGHT or immunity, under certain conditions”
“the principle or condition of enjoying special RIGHTS or immunities”


This privilege we are talking about comes with a PRICE. It has a handsome fee attached to it.

I believe if was invited and paid for the entrance fee.....that gives me ALL THE RIGHT! And mind you, the PRICE here does not constitute to financial aspect alone, also the time and efforts spent.

CIC made an oversight in not bringing out caps to control numbers a lot sooner than this. I don't suppose anyone could have predicted the 400,000+ applications they would receive during the time of the first set of MI. But, having made that 1 mistake, they have recognised the need to control numbers and are now doing so.

And I will grant you that their communication can certainly, and should certainly, improve. But I don't think it's fair to say you've been "cheated".

You as a post-Feb-2008 applicant were quite happy to "jump the queue" ahead of applicants from 2007 and earlier, some of whom had been waiting for 3/4/5/6 even 7 years when the first set of MI's came out. With hundreds of thousands of uncapped applications pouring into CIO a second set of MI's was inevitable. Those under the second set of MI's are received the same advantage you guys got when the first set of MI's came out.

You haven't been "cheated" any more than the pre-Feb-2008 applicants were "cheated" when the first set of MI's came out. I don't recall too many of you guys offering to wait for all the pre-Feb-2008 applications to be processed before you, because that would only be fair and you wouldn't want to cheat them? :)

And I also don't remember CIC promising a visa within any timeframe. They gave timeframes based on average processing times at the visa offices, as they currently stood. They offered no money-back guarantee of an exact time you would get your visa.

But anyway, minor rant over, the good news is that by controlling numbers CIC are now getting less applications per year than they have the resource to deal with, rather than significantly more. Which means each year they will be able to eat further and further into the backlog. By making changes such as sending all supporting documents with the initial application they have streamlined the process - and I believe that once all the backlog is clear the majority of applications will be completed from start to finish in 3 to 6 months.

And I don't wish to sound unsympathetic - I appreciate how frustrating this must be for many applicants. I wish CIC would improve their communication so that they could at least give applicants reasonable timescales rather than just "we don't have time to look at your application right now". I had hoped with the transfer to GCMS we could get more detail and transparency from CIC regarding the status of applications - but this hasn't happened yet.

Personally if I were in charge of CIC right now, I would make sure all the new MI's were processed in a timely fashion, which is a relatively small number, and then dedicate the rest of the resource to evenly clear the backlog between pre and post Feb2008 applicants and "ease" those applicants into the system. Baring in mind if those applicants, many of whom no longer have in-demand skills, are brought into the system in too great a number this will have negative impact on the Canadian job market.

If you decide to collectively approach CIC with this then I wish you the best of luck.

But one piece of advice is rather than going on the offensive with "this is not fair, we should not have to wait this long, it is our RIGHT to be processed" which will just end up in the bin at CIC - I would go with a more constructive approach.

The facts are CIC has over 300,000 applications in its catalog of pre-June-2010 applications. CIC has a certain amount of resource to process it all, and has to by mindful to not allow too many immigrants into the country in any given year which have neither in-demand skills or a job offer, since this will have a big negative impact on Canada's job industry.

With this in mind, my advice is to try to consider it from their side of the fence and make suggestions as to how they can do it better.

In a nutshell, I agree CIC have made some bad mistakes, but without inventing a time machine there is nothing anyone can do about they way things have been handled in the past. Rather, it is much better to focus constructively on how things can be improved for the future.
