Hello

I am a Canadian PR.
My husband is a Canadian Citizen.

My PR is expiring on 14th June 2021. As of now I am outside Canada.

I am planning to return to Canada in May. And on landing I’ll be applying for my PR renewal. But I see that I don’t satisfy my 730 days eligibility requirements for my PR renewal.

Please could you help with my situation. Below are my travel details in the past 5 years.

Landed in Montreal as a PR - April 20th 2016

Travel outside Canada.

1. First travel:

October 7th 2017 - left to India
May 22nd 2019 - came back to Canada

I was found pregnant in October 2017 when I reached India and ended up having some complications, so I stayed back in India during my pregnancy and during the maternal/parental vacation.

2. Second Travel:

30th October 2019 - left to India
Planning to be back in May 2021 once the summer starts in Montreal.

I came back to India in October 2019 with my kid but got standard here due to the COVID situation. My husband also came to India and has been working from here for 6 months.

Kindly let me know what I can do in this situation. My physical presence in Canada sums to 680 days. I am short of 50 days.

I came to know that I can add days abroad if I travelled with my spouse. But in my case though my spouse is here in india with me for the past 6 months, we dint travel together.

Please advice if there is a way to meet the 730 days criteria for my PR renewal.

thanks in advance!!

From how I've understood it, any days outside of Canada with your Canadian spouse counts towards your days in Canada

It depends. Sometimes IRCC applies the "who followed whom" rule in which case this isn't necessarily true. Hard to give a clear answer on this.
