My PR application was refused, for these reasons:

Dear xxxxxx

I have now completed the assessment of your application for a permanent resident visa as a member of the Provincial Nominee Class and have determined that you do not meet the requirements for immigration to Canada.

Subsection 16(1) of the Immigration and Refugee Protection Act states that a person who makes an application must answer truthfully all questions put to them for the purpose of the examination and must produce a visa and all relevant evidence and documents that the officer reasonably requires.


You were asked on 03 December, 2014 to provide the following documentation:

1) Evidence of on-going relationship between you and your spouse

2) Copy of letter of employment from your current employer that clearly indicates your employment status, start date, salary and contact information for your employer

3) Copies of your pay stubs for the last 6 months

4) Copies of your bank statements for the last 6 months

This letter informed you that if this office did not receive the required evidence and documents from you within 60 days of the date of that letter, your application would be assessed on the basis of the information that was already before the officer.




But I swear to God that I sent all what was requested, I dont know what theyre talking about.
And when I called the CIC call ctr. they said everything is going good....
What to do now.. Im so sad and torn :(

I am soo sorry to hear this. I think there's a way to appeal PNP PR rejection. I'll have to do dome research.

You can send a PM if you wish. The first question is...where you truthful? If you were truthful then....the easiest story to tell is a true story and the truth will always win. If not, then there's a bit of a problem.

You provided all the documents but do the documents contain all the specifications spelled out ? What I mean is for example in the inquiry about proof of employment, did it have all the information - start date, current status, and most importantly phone number. And...is the phone number correct ? not entered mistakingly ? That'll be the starting point. Do not lose hope yet

It seems that the documents never reached CIC. It happened to me too. I sent them by email and 3 months later they sent me an email "Final notice" to comply. I freaked out but I sent them an email explaining what happened followed by the documents sent by regular mail. Also, I mentioned that I needed an AOR when they get my documents and they emailed me saying they got them all.

Refusal over late documents can be appeal and can get the case reopened, Unlike criminal refusals.

Thats what i was thinking too..Maybe the documents didnt reached CIC. But luckily I have the receipt here for the courier...So I dont know what will happen now

And ofcourse everything is true..We never lied..I cant believe how easily they make a decision. :(
 
I would suggest to track the courier and get details on when it was delivered and who was it delivered to( signature on receiving the package) and call them or email them the same and of course as others said- lawyer and appeal!!!

Still waiting. My story is messed up... I added my wife in July and they moved my received date to July and said my application will be processed with the applications from July 2014 even though I initially submitted it in March 2014.

Chances are you will win this case over CIC with the help of a lawyer and evidence to show you actually sent the requested documents to CIC. My major concern is that if eventually the case is re-opened, it may take longer that usual to complete, especially with the way CIC is operates. One thing is certain, you will definitely win this case.
 
I emailed Ottawa today with the proof of receipts that my document was received. I hope they can reopen my case. And i hope I can get a lawyer soon.


Does anybody know of situation like this that won a case?

I'd suggest you follow-up with a registered letter to Ottawa, containing the same proofs that show you have complied to their request for information:
- include in the letter that you believe this was an error in processing
- state also that you have complied to their requests for information and provide a general timeline of when you received the instructions, when you responded and sent the documents required and when it was received in Ottawa - the courier tracking receipts will then fall in line with this timeline.
- it would help your case if you can provide copies of the documents you sent them before

As this becomes now a issue wherein one-side has to prove who erred - I would not rely on just email as the mode of communication/correspondence only. Send an email, in the interest of time, but follow-up with the letter a few days later.

Thanks ragluf! Thats what i did. But after talking to my PNP Officer this morning, worst case scenario is i needed to reapply a PNP again, then reapply a PR again :( :(
This brought me in tears :(
