Hi - hoping someone here can help with this...

My wife (Trinidadian) and I were married in Dec. (~6 months ago) after dating for ~5 years. She has been in Canada more or less for the past 3 years, on a Visitor VISA - however since she has always abided by the terms of the VISA, she has not stayed longer than 6 months at a time. She has never had any trouble entering the country.

We have completed the immigration forms and are ready to submit, but I'm not 100% certain whether we should be applying from within or from outside Canada. She is currently within Canada, but not technically living here (here as a Visitor). In the forms, we've put her Trinidadian address (her parents' address, that she calls "home"), and not my address here in Canada. Is this the right approach? Or for the purposes of the application, is she "living in Canada" or "living in Trinidad, and visiting Canada"?

Maybe I'm over thinking it, but want to make sure that a) we use the correct application process, and b) do not indicate incorrectly where she is living (I guess what I'm wondering is from the CIC's perspective, are they referring to where someone is legally living? Or where they are "hanging their hat" during the application process?

Really appreciate the help - this is the one piece I'm finding most confusing.

Oh, PS...I did read the pinned post which is very helpful in discussing inland vs. outland...I'm just still not quite clear if I need to be concerned about the technicality of "home-country address" vs. "Canadian address" as it relates to "living in/out" status :o
 
hello,

if i were you, i would choose inland. inland can take less than outland in your case - 18 months vs. 23 months outland... (including all steps). see here the VO for Trinidad and Tobago: http://www.cic.gc.ca/english/information/times/perm-fc.asp

your wife wouldn't be able to leave Canada during the process though, keep that in mind.. she'll get implied status if you do inland - also the adress will be your canadian adress.


you can choose outland as well (it would be her home adress then) and she could try to extend her visitor visa, but if they deny it then she needs to leave..

also watch out that there are different forms & checklists for inland and outland.
