I got my pr in 2016 which expired in 2021. I lived in Canada for 5 months. My mother and my brother got in several accidents in 2018. My mother passed away. My brother was in critical condition. As a result it was impossible for me to stay in Canada. I had to go back to my home country and live with my father. Now I am 20 years. Is it possible for me to come back to Canada. Any kind of guidence will be appreciated. Thank you

Two options:

1) Fly to the US, re-enter Canada through a land border using a private vehicle, and hope you are not reported at the border for failing to meet the residency obligation. If you are not reported, remain in Canada for 2 years without leaving to meet the residency obligation and then apply to renew your PR card.
2) Apply for a PRTD (PR Travel Document) under H&C stating the reasons why you left Canada and were unable to return to meet the residency obligation. If the PRTD is approved, you can then fly back to Canada.

I’m sorry for your loss. Do you have a US visa? Did you obtain a SIN#? Do you have any medical conditions? In some provinces you won’t be able to get a health card without a valid PR card. Your health card is probably expired but even if it isn’t you would have to reapply since you haven’t met the residency requirement to qualify for public healthcare in any of the provinces. If you do come to Canada via the US border without being reported you should take out private health insurance to cover your emergencies. Your brother was in critical condition in 2018 but how long did he remain hospitalized, need care for daily activities, etc.? How old is your brother? Is your father involved in your life or if not who else became your guardians? Has your brother remained unable to work, study, care for himself, etc.? If he remains disabled what has changed recently that would allow you to come to Canada and be able to commit to remaining in Canada for around 2.5 years without being able to leave? The past 2 years since you turned 18 are fairly important for IRCC. What was preventing you from coming to Canada in the past 2 years since you turned 18?

Thanks for your response. I do not have a Us visa. I also do not have any kind of minor or major health conditions. My brother accident was in October of 2018. He remained hospitalized for 4 months. After he was unable to talk or walk around. Another 11-12 months of rehabilitation was needed. After 2021 he was able to talk and walk but he is still not 100% normal. He is currently self-sufficient in most of his daily tasks. He sometimes require help if it is something complex. Now my brother is 23 years old.
My father is my sole guardian. My father remarried. So it wasn't possible for my father to go and live in Canada for 2.5 years without leaving. I lived in Canada for 5 months. I became quite fond of Canada. I wanted to live there. I tried to convince my father to atleast let me live there after I turned 18. But he refused. He thought I wasn't old or mature enough to live in another country without a guardian. I live in Bangladesh. It's a third world country. There is no part time job or anything that would allow me to save enough money to go to Canada and live on my own. Now I have finished my Higher Secondary studies. My father said if it is still possible for me to return to Canada he will allow me to go. This is why I am doing research if it was still possible. And going to Canada by crossing through USA border and hoping to not get reported. I do not think my father would allow it. He will probably only allow me to go if it is through offical means. Anyway thank you for your response. I really do appreciate any kind of guidence.

But many married couple live their separate lives in different countries, so wondered why your father cannot do the same. Your father and you could have live in Canada and then sponsor his wife to become PR. It looks like the only route is apply PRTD on H&C for you.

My answer probably won't be 100% correct. It probably had something to do with his marriage. It was a new marriage. It is important to establish a bond with each other after newly married. I don't think it is reasonable for me to say anything about it.
Also another reason he did told me was he was getting old. He is currently 51 years old. He has many health issues. In Bangladesh he has a government job. He lives quite peacefully here. He said it would be hard for him to go there and establish himself in there. It would require a lot of hardship on his part. I believe this fear of new challenge and hardship eventually hold him back and he decided not to go.

In order to cross the border from the US to Canada, you would first need to obtain a US visa. Without a valid US visa, this is not possible.

The alternative is to apply for a PRTD (PR Travel Document) with H&C considerations and hope it is approved. If it is approved, then you can fly directly to Canada.

As others have described, since you don't really have the possibility of travelling through the USA, you can apply for a PRTD (PR travel document) with H&C considerations.

But: you must make clear two things. First, you were removed as a minor, your father made the decisions. Second, the other issues and considerations that prevented you from returning to Canada as soon as possible after the age of 18.

Dates are not clear but if you are 20 now, you were already an adult in 2021 - obviously I do not know the month. But it will not look particularly good in this case if you had your PR card at the time you turned 18 and didn't just use it then. (I doubt this is a strict rule, it just doesn't support your case well).

Also, you refer to events (the accident and rehabilitation) that occurred well before you turned 18, and there is not much that you have described since then to have prevented you from trying to return to Canada.

Anyway: nothing for that. You should not delay much more, make the best case you can and submit the PRTD application.
