Dear Leon,

My PR cards are due to expire in April 2013, but do not meet the PR requirements. I had some family obligations, which was retaining me from going to Canada. My mother has now passed away and I want to retain my PR status.

I do not want to be held up at the immigration, as would be travelling with my full family (Husband and three kids).

Please advise what documents would be needed to request for an appeal & can that be done before I enter canada. If I get a job in canada, can my whole family enter canada.

If you were taking care of your ill mother, you have a pretty good chance to keep your PR. Get some medical reports and statements from doctors that treated your mother as well as her death certificate. Go to Canada with your family before your PR cards expire and if anybody asks you anything, state that you were outside Canada taking care of your sick mother who has now died and you plan to renew your PR on Humane and Compassionate grounds even though you do not meet the residency requirements.

It is most likely when you have good reasons like that, that immigration will just let you enter Canada without any action. You then have two options. You can apply to renew your PR cards when they expire sending in your documents about your mother or you can wait until you have a full 2 years in Canada and then apply to renew your PR cards normally without any supporting documents as you will then meet the requirements again.

If immigration reports you for not meeting the residency requirements as you enter, they will let you enter but you will have to appeal for your PR using your documents.

You can not appeal for this before going to Canada while you still have a valid PR card.
