Hello all
My wife became a PR in Oct 2015. Due to work commitments she could not spend time initially in Canada. She moved permanently in October 2018. In between she had to go back home for a month. Her PR card is valid till March 2021. She would be completing 2 years in December 2020. Will her 5 years be calculated from Oct 2015 or last 5 years when she applies for renewal in December 2020. Will it be ok if she applies for renewal or will it be considered not meeting her residency obligation ? Really stressed about it. Please advise

It will be calculated from the date she applies for a PR card, i.e. from December 2015 to December 2020. She does not need a valid card to remain in Canada as a PR; the card and the actual status are separate. She should simply remain in Canada until she meets her RO. Past non-compliance does not matter as long as she is in compliance in the five years immediately preceding the date of her application for a new card.

Primaprime one more question please. Her landing date was 17 Oct 2015. Till 17 Oct 2020 she has 714 days. She might have to travel for 3 weeks due to family commitment around 24 Oct. Will it raise a red flag with border officials if she travels and apply for PR renewal on her return after completing 730 days ? Thanks again

Check my guide to the RO (link in signature) for a fuller explanation, but her first RO period is fixed, from 17 October 2015 to 17 October 2020, and the question looks forward to whether there is enough time left for her to accumulate 730 days by 17 October 2020.

Then, on 18 October 2020, the period becomes a rolling window from 18 October 2015 to 18 October 2020, 19 October to 19 October, etc., and the question looks back to whether she did accumulate 730 days within those past five years.

Compliance will be assessed upon an application for PR card renewal, and may be assessed at the border. If she has basically lived in Canada for the past two years and is only a couple weeks short of 730 days, I would not expect to face much scrutiny at a border crossing, but the possibility of being reported for non-compliance and entered into revocation proceedings is always there. So to be fully safe, she should not subject herself to a compliance assessment until she meets her RO.

She should really avoid travel until she is above the 730 days with some padding.

When i see her I94 records it mentions her departure on that date. Any idea where she can get it corrected ? Does CBP ie US immigration have office in Toronto where she can go to ? CBP site mentions she needs to go to inspection site. Do we have that in Toronto ? Thanks again for your help.

You would likely have to get it corrected at a port of entry or CBP office in the US. You can call the US consulate in Toronto but I don't think they offer that service.

Do I need to send separate envelopes for PR card renewal for my wife and son or can the entire family's application be sent in the same envelope? Also can i pay the fees togather for my wife and my child or do i have to create a separate account for everyone to pay the fees?
