Dear Friends,

I need an advice and that too quickly. The issue is that I got my PR and SIN cards in June 2010 when I landed, stayed for 20 days and came back to my home country India. BUT now I plan to move to Canada and want to complete my PR process thereby enabling me to extend the PR.

Can you please advice if the above is possible?? your immediate response shall help.

If you landed in June 2010 and stayed for only 20 days, you will be unable to meet the 730 days in Canada in 5 years residency obligation for your first 5 years as a PR.

If you go to Canada now, one of two things will happen.

Either you will be allowed to enter in which case you should sit tight, not leave for 2 years, let your PR card expire and not apply for anything from immigration until you have your 2 years done. Then you can apply to renew your PR card normally.

Or the other possibility is that the immigration officer will report you for not meeting the residency obligation. They would still let you enter Canada but you would have to appeal for your PR showing good grounds for why you were unable to meet the RO. Immigration will then decide if you lose or keep your PR status.

In order to have the best possibility of keeping your PR, you should return to Canada as soon as you can. The closer you are to meeting the RO, the less likely it is that you will be reported or that you will lose the appeal.
