Hi,

Mine and my family PR card expired in Oct 2014 without meeting the required days obligation as my father was not well for last few years and I had to be there on his side by then as an elder son. Unfortunately I lost my father this year. But in June 2012 I wrote it to Canada high Commission in New Delhi, India and also sent an email to CIC, Calgary - Canada as a plea on H&C grounds that I might loose my family's residency in Oct 2014. But not to my surprise I got a standard reply of days obligations and forwarded to a link.
Now I am trying again through an Express entry but have not surrendered my PR yet.
1- Is this the right approach to get a new PR?
2- I had not surrendered my PR yet. Should I do it before entering an Express entry pool? What will be the repercussions?
3- Will this go negative against my new application?

Please advice.. as my father health was the utmost important factor for me then but now he is not there anymore can I still go via the mode as mentioned above.

Instead of just renouncing your PR status, you should formally request a PR Travel Document on H&C grounds. If the PRTD is approved, you will immediately overcome your RO issues and can return back to Canada/apply for renewal of PR card.

If the PRTD is refused, then your PR status will be revoked and assuming you don't appeal it, you would then be free to re-apply under EE.

The previous PR status should not have any effect on new application.
