Hi Experts,

I have a question regarding which work permit should be used when i apply for my PR application under CEC category. I am currently in Ontario and I have closed work permit with my existing employer valid until Dec, 15 2013. I applied for a new Job with positive LMO and the same was approved for new employer valid until end of 2014. I am unable to join the new employer now due to some unforseable circumstances. Meanwhile, i plan to submit my PR application to get it going. I am confused which permit should i use to include in my application i.e. what end date should i put for my status in Canada? Would I be eligible for bridging open work permit while the PR application is in process.

If you submit your application with the wp Dec 2013 you probably can apply for BOWP when you get your AOR, wich probably you can't with the new employer until sept 2014

4. So you suggest applying with the permit I am using for current employment so that I can apply for BOWP. Do I have to include any explanation with my application that I am working for the new employer?

Thanks Jorger,

my consultant had confirmed with CIC agent that I can continue to work with the old employer until the time my WP is valid. New permit doesn't say it invalidates the previous one from old employer. I went through the post but it is very confusing. New employer lost their business with the end client, seems it may not work out. In such situation what is the available option - Is it possible to decline the new WP and have it cancelled as I don't want it to jeopardise my PR appln and status in Canada?

Then, if this is the case apply with the wp valid until Dec 2013, ASAP so you can have time to apply for BOWP, hoping you the best with your PR application.

Thanks Jorger. I am still confused why the CIC agent stated differently to you when you got your new WP that you can no longer use your old one which was still valid. DO you have any remark on your new WP to this regard?

I think the VO meant if you start the new job and then try and go back to the old one, at that point its invalid.

However you didn't start this new job (and in turn didn't start a new work permit from LMO)

Look at the LMO as a job offer, which it is. You just didn't go with it.

You continued employment with the first employer, so no problem. Once you have complied 12 months with that company, then apply.

When you get AOR, then apply for BOWP, simple

No there is no remark on my new work permit about invalidating the old one,
but as usual on closed work permit it says
1.-the date i have to leave
2.- unless authorized prohibited from attending any educational institution
3.- not authorized to work in any occupation other than stated
and here is the thing I think...
4.-not authorized to work for any employer than stated
its not invalidating the old one but it is not the employer stated in this wp

I'm agree with suvan, in my opinion you can use your actual employer to apply,(It is good you have not started with the new one) and as soon you have your aor apply for bowp

Hi guys - I am mostly ready to send me application package to CIC in next couple days. I had one quick question, hope you guys can help?

Would it be okay if i take the new Job after i send in my PR application with the old WP? Do i have to include copy both the permits with the application package and state the fact that i am not using the new one with the new employer and continuing to use the old one? what is the best course of action?

If anyone has similar experience or know someone in similar situation, would request to provide some guidance. thanks

for your application counts only facts, the work experience you have, your new work permit is irrelevant as you have a wp but have not used it. Include just the info up to date to the date of your application.

Thank you very much for your inputs earlier. I received my AOR last Friday. I am preparing to apply online for BOWP but have some confusions on couple of points on the Application form, hope you guys could help me with your expert advice.

1. On the Application IMM5710 - point 3, where it asks I am applying for one or more of the following - What option should I select for the BOWP - WP with Same Employer or WP with New Employer
2. If I select New Employer - What should I put under Name of Employer as I do not have a offer from any employer.
3. Where do I mention that I this application is about BOWP?
