Yes, you can use this Indian PCC now if this has been issued at the Indian Embassy of your current country of residence. You must mention about this fact of last day spent in India in 2012 in Letter of explanation.

It's good that you have clarified your scenario here. In this case, even though your actual days of residence are below 180, the VO takes Jan-June period into consideration and will want you to submit a PCC for this country. So, it's better that you obtain a PCC for this country.

If the authorities of this country deny you the PCC as you resided less than 180 days, then you must obtain evidence (email or letter) stating the same and explain IRCC the reason why you could not obtain PCC for this country.
Please correct me if I'm wrong, I think what you are pointing out is in case of permanent residency, and not in case of visits on visit and business visas.

For instance, I made 5 visits to Maldives between Dec-11 to May-2013 and similarly 5 visits to Sri Lanka between Aug-2014 to Feb-2016. Some of the visits were on visit visas whereas some visits were on business visas for both of the countries. The total number of days spent in each country is less than 5 months if counted from the entry and exit stamps. I understand that I don't need PCC for both these countries. Is that correct?

The no. of days spent in a country are not based on the type of visit on which you resided in that country. Even if you have spent close to 180 days on a visit visa in a particular country, then you must obtain PCC from that country. If that country does not issue PCC for people staying on a visit visa in that country, then you must clarify this to IRCC. Whatever may be your situation, make sure you explain that in a proper way to IRCC.

If you are not submitting PCCs for these countries as you are sure that you don't need them, then kindly help IRCC understand this fact of not obtaining PCCs since you stayed less than 180 days in these countries. All the best.

Thanks for clarifying. To be exact, I have spent 135 days in Maldives and 145 days in Sri Lanka which is less than 5 months in each country. I will also explain this in LOE.

hmmm, your calculation makes me worry... My spouse had 5 visits to the USA, no longer than a week each... I was not even thinking we needed a PCC from US. if they calculate months, not days-wise then it might be considered as 5 months
Do you have a CIC link on that? thanks

well, I am familiar with that link, but I still fail to see where it is written that the calculation will be done as you said.
Have you seen cases when people were rejected because of miscalculation? I am confused

It's mentioned in that link itself:

For example: if you visited, worked or lived in a country for two months, left for a few years, then returned for four months, that counts as spending six months there. In this case, you would need a certificate.

exactly :) for 2 months+4 months, but its not mentioned how the "month" is going to be calculated, right? At least I dont see any indication in that sentence to make such conclusions.

In fact, that explanation was updated, in order to show that 6 month-period is cumulative. In the beginning PCC was required if one stayed in a country for 6 months in a row, as far as I remember.
Anyway, let`s see what others have to say

I agree. The 6-month period considered by CIC is probably the number of days spent in a country irrespective of number of visits or the calendar years during which 180 days or more were spent.

Hi Guys,

I have a question that I cant seem to find an anwser to anywhere, and I just want to be sure to avoid any confusion or take chances with CIC

I am an indian citizen/passport holder but I was born and raised in a different country (UAE). I have not lived in india cumulatively for more than 6 months since the age of 18.

My question is, is it important to get a PCC from the country of your nationality if you have not lived there for 6 months?

CIC does not explicitly state anything in this regard, but assuming the kind of experiences people have had specially with PCC, I would just like to get a second opinion

Thank you so much!

AFAIK, you will not need a PCC. But have you visited India and was the total time spent in India more than 6 months? In that case, you might need a PCC.
