We've been talking about permanent residence for a long time. I was a student in the US when we started dating and we were originally going to apply outland (I clearly need to update my information). My boyfriend is currently living in Canada with me and working under the NAFTA provision with a visa set to expire in March of next year. We want to apply inland so we can apply for the open work permit to extend his working time as well.

While the first stage of approval in applying outland is faster, the second stage is currently listed at 26 months, which is much longer than inland. And it wouldn't allow for the open work permit.

Thank you for all of your advice! I think we're going to go to a fingerprint technician instead of DIY'ing it because we don't want to take any chances.

However, if anyone else wants to weigh in, I'm always happy to hear more advice!

You're very welcome!

FYI, stage 2 for an American is NOT 26 months, unless it's an application that has some `red flags'. Most Americans that apply Outland (even while being in Canada) complete the entire process in under a year.

You really should reconsider an Outland application.

Thank you, Ponga!

I had heard that it was faster, but seeing the 26 months second-stage timeframe on the CIC website has me scared. Does anyone have any idea why this might be so inaccurate? That's what has held us back most of all. That and he maintains his primary residence in Canada, and I thought you had to have a US mailing address to apply outland...

Also, we just paid our fees which were for the inland application so I'm not sure how to go about changing that.

I'm so sorry for all of the questions! We've been looking into this for years, but between moving and our work commitments, it's never been the right time until now. And all of the information I've gathered over the years has made it quite confusing.

Thank you!

For us Outland applicants you want to be looking at Ottawa time frames. Even that is inaccurate. The average seems to be 8-10 months. What is listed on the website is not average. A senior member can explain because it confused me. Don't look at processing times for the us because only applications that are red flagged go there and very few us applicants get kicked back to the us. This is they don't believe your relationship to be true or if there is some criminal issue with the applicant.

I don't know why, but CIC doesn't communicate that an American application is processed in Ottawa, unless there are `issues'. He can use a relatives address for his mailing address, while he is `visiting', or residing in Canada.

You should contact CIC and ask them how you can cancel the payment and re-apply Outland. The fees may be the same, less the OWP fee of $155.

RCohen and Ponga, you're awesome! Thank you for the guidance.

I can't imagine we'll have any trouble or red flags. We've been together for five years, living together for four. No children, no previous common-law relationships or marriages, no criminal records. We have 450+ pages of evidence to support the relationship.

I wonder how tricky it is to go about getting a refund from the CIC... That's going to be a tough one.

I'm going to look into the outland application tonight! If we can get this wrapped up sooner, all the better.

Just so I understand, we can use a mailing address in the US but let the CIC know that we live in Canada?

Cheers!

if the applicant is living in canada legally under a work permit at the time the application is submitted, i don't see why you can't put the canadian address. also, yes, you can change the address to a canadian one for the applicant. many people do this when they are visiting spouses.
