hello everyone , am from morocco i am new in this forum ....but howeva doesnt mean i havent been reading about it .....anyway my prob is that my wife was gettin ready to apply for a sponsorship but what happened was that she read in thier website that she cant apply for it not till she complete a 5 years cuz she was sponosored to come canada ....btw , she is an american .......i just wanna know if this is really true or not cuz this is really scary me plus she entred to canada in 2009 , so if so that would need one year and 4 months to be able to apply for it ......... this is kinda stupid ..........pls i need your help guys .......thx in advance ....... Sad
 
If your wife was sponsored for PR through the spousal sponsorship program - then yes, she must wait until 5 years after her landing date before she can sponsor you. If she became a PR sometime in 2009 then she will have to wait until 2014 to submit the application to sponsor you.
 
If your wife was sponsored to Canada as something other than a spouse, then she can sponsor you now.
 
yes she was married with an ex canadian man once she was sponsored by him so we got married in MARCH 2012 ;;;;; BUT anyway can i visit her durring this periode of waitin cuz its really kinda sucks , and i am really gunna lose it to be honest , i mean what the point of all this lows anyway as long as she meet all the requirement what the point of this stuffs pointless huh ??? ....
 
As long you can Get a visa, you can visit her....
But If was sponsored,she needs to wait 5 years from the time she was sponsored
 
The point of the 5 year sponsorship bar for sponsored spouses is to curtail the merry-go-round of sponsored spouses who arrive in Canada, promptly divorce their sponsoring spouse, marry someone else and sponsor their new spouse while their former spouse is unable to sponsor anyone else for 3 years until the undertaking that covers them is expired. It was a very unfair situation that was widely abused, and the current legislation seeks to redress the imbalance.

You may seek a TRV or other means of entering Canada in order to spend time with your spouse in Canada, but until 2014 she is not eligible to sponsor you.
 
thank you very much Guys i really appreciate all ur comments but anyway but now i dk what to do durring this two years at least i am thinkin to go to the embassy and ask but it would be just the same answers which means i have to wait before she can be able to apply and in other hand the visitor visa i dk what r their requirements as well see this is completely sucks so far am just gunna lose it to be honest i dont know what to do
 
samy77: what are you gonna lose from what ? this rule was implemented upon a thousands of survey from all over. So it is not sucks, rather it became a tool to stop fraudulent marriages......You should be happy about it. Good luck..
 
If she's an American, she might be able to sponsor you into the US without having to wait the extra time. Just something to consider, don't know if it will be feasible for you.

You are correct, the embassy would not tell you any different from what we here have told you, if they would tell you anything at all. They are not in the business of providing counseling on immigration matters, their job is to process applications.

Waiting sucks, but getting a visitor's visa shouldn't be too difficult to obtain as long as you meet the requirements. Stay positive and while it's not ideal, using Skype can help a lot.

yes she is an american but aint live there for like 4 years ,i think u r right but the thing is she has to meet their own requirements again which means she has to drop everything she built in canada to start over again from nothin in US , that would be another extra time that the point am i right ???

yeah josh ...but am just trying to see thier requirements cuz its completely diff from country to another so here in morocco kinda also sucks needs more prove to show that u r related to come back as soon as u finish ur visiting periode that another thing how to prove that to a visa officer .....that another thing am thinkin about ...plus i ve just graduated and they would have so many doubts in me for not coming back that the prob

yeah u r kinda right cuz as u mean it would be showing more proves that our marriage not fake so look how long its last .......that a good positive part of this situation as well thank you so much
 
samy77: This is the only immigration sector got 'abused' too much and now we have been suffering! I understand you frustartion and at the same time I think 5 year bar for sponsored person is good. so that they can think twice about doing any bad decision. People are so greedy they will take few thousand dollar and sponsor someone to bring over and that person willl come here and sponsor other person for money! Did you ever think about it ? How to stop those frauds ? Do you have any 'great' idea yet ? This is abuse? Right ? Thanks.
