hello , I was deported from Canada on rainbow Bridge Buffalo,NY-Niagara on 2020-03-18 , my cause for removal/inadmissable is 41(a);20(1)(a), criminality (no), danger opinion (no) , removal under escort (no) , detained for removal (no) , ive been a green card holder and im in usa right now, in 2019-01-08 I applied for refugee asylum in Detroit border because I wasnt let in into canada because of my 1 misdemeanor which it wasn't a conviction i ended up getting supervision but I was booked for it and fingerprinted , im in the process of expungment and it will be erased from my file in 2-3 months max. My refugee court was denied on 2019-11-09, i did not have a lawyer so i didn't know much but I was suppose to leave canada 30 days after but I ended up overstaying because I didn't know. But right now I've been in the usa since I got deported on (2020-03-18), I already mailed my familysponsorship through my mom on July 29th and my tracker shows that they received the application on June 2nd, is it going to take years for the application? And my other question is im I elgbile for TRP ? I want to wait till the borders open up and go to the border and apply for trp in person, i will grab documents from work showing i have to come back and buss tickets 2 way and doctor papers from canada showing my grandparents and my mom have bad health and I just want to see them before anything happens god forbid. I just want to have a chance to go see them so is a trp something for me or what would be other options ? And would I be able to go and apply in person ? I read somewhere that u are elgible for trp if its been 12 months after ur claim was denied and my court case was on November so thats few months from now so would I be elgible? If so can someone please direct me on steps or how to apply for other application if im elgible for something?

- You have to wait 12 months from the time your refugee application / appeal was refused before you can apply for the TRP
- TRPs are not being accepted at the border at this time. It's possible CBSA may start accepting applications again in September. Also possible the border closures will last many more months.
- Your chances of a TRP being approved are likely very low given your immigration history in Canada

You have no other options at this time other than the TRP. You should assume your sponsorship application will take more than 12 months to process given you most likely need an ARC.

One last thing I read somewhere that u had to had made appeals to some boards after refugee claim was denied to be able to apply for trp is that correct ? Because I didnt make an appeal for nothing after my refugee claim was denied i just ended up overstaying by accident then left when the immigration told me that departure order turned into deportation order

and I cannot find a trp application whatsoever online, would u recommend that I would get a canadian lawyer for this application or it can be done by myself ?

Hello so those are on the refugee book

Obligation on entry
20. (1) Every foreign national, other than a foreign national referred to in section 19, who seeks to enter or remain in Canada must establish,
(a) to become a permanent resident, that they hold the visa or other document required under the regulations and have come to Canada in order to establish permanent residence; and

According to Section 41 of the IRPA, a person is inadmissible for failing to comply with the IRPA:


  1. A-In the case of a foreign national, through an act or omission which contravenes, directly or indirectly, a provision of the IRPA; and

I dont know what this means, I mean I never had a lawyer for my refugee case i just went in by myself because I was advised a lawyer wouldn't make a difference and that I was getting a denied either ways, but in my refugee court I claimed that I was running from America because I was being harrased and abused for being middle eastern

Do I do arc or trp or what do I do ??

The expungement won't necessarily fix the inadmissibility from IRCC's perspective. IRCC may still say you are inadmissible even after the expungement is approved.
