My husband and I got our landing paper which expires in May. We were planning to landing early in April for a week. However, I recently got pregnant again with a twins. My doctor advised me to stay in bed and not taking any flight. Because I'm the main applicant, my husband has to go after me. Now I'm really in trouble: we were thinking about returning the landing paper and visa to CIC and explain the reason as the doctor said, and ask for an extension of the visa. However, we heard from some people that CIC has recently been very strict, and may reject our application or even cancel our immigration visa.
Is anyone here who knows the possible outcome? And what else can we do to possibly delay the landing? Many thanks for your help!!

A very peculiar situation indeed!

At the outset, you can perhaps meet a couple of more Gynacs and seek alternate opinions on your case. And then take your judgement.

While I am not aware if you can return the Landing Papers, please note that if you plan to re-apply, then you have to not only go through the whole process, but also ensure that you do the process for the babies that would be born. Even if you apply for the extension of the Visa (and in case if that application is accepted and honored by CIC), you need to do the paper work for your babies too.

Nevertheless, if you personally feel that your current health conditions permit you to undertake the journey, then you can possibly try to complete the journey now itself - perhaps you can consider travel by Business Class, for instance which gives more space / flat bed configurations, so that the journey is more comfortable.

You will be aware that the babies born after you land, will by birth, become Canadian Citizens! And this will avoid all the paper work at a later date.

At the end, it is what you wish to do, in either of the choices.

Congratulations on getting your PR and your twins. I am sorry that both major life events had to come at the same time. I thought the suggestion of business class was inspired but I don't know your maternity history and am sure you explained the importance of the flight to your doctor. Did your doctor give you any indication of when it could be safe for you to fly? I would contact CIC and ask for some compassionate advice. All the best.

One more thing.

All of us who are on this Forum have dreams of landing in Canada and prosper our lives (the very reason why we have applied for Immigration, in the first place!). I am sure you are no different!

On a personal note, just think and dream what you would be giving to your babies, upon their arrival into this world!

THINK POSITIVE! AND EVERYTHING WILL TURN OUT POSITIVELY!

And whatever decision you take at the end, abide by that and don't think otherwise, at a later date.

Can I ask one more thing: when you mentioned we need to go through the process again, do you mean that we will be treated as a new case by CIC (which means we need to meet the most recent immigration criteria, not the previous one when we applied?) Because if so, we won't be qualified. Thanks!

Yes - you will be treated as a new case.

And yes - you will need to meet the most recent immigration criteria to be able to apply.

Hi Puccanan,

Option - 1.

In case you apply for extension and if this is not granted, then the logical conclusion is to re-apply afresh, since your VISA would have got expired. In addition, note that you would then be 4 Applicants (since you mentioned twins) and NOT 2 anymore. Therefore, you would need to submit the Application for 4 Applicants and NOT 2 (and go through the whole process once again, aligning to the new Procedures and eligibility framework).

Option - 2.

On the other hand, assuming that you indeed get the extension of the VISA, and you wish tho undertae the Journey AFTER the birth of the Babies, then you would need to apply for Passports for the Babies and also complete the required formalities with the CIC, for inclusion of their names for the Migration.

Therefore, in both the cases, there would be significant delay / lot of paperwork involved.

The Third option, of course is to fly ASAP and welcome the new born babies in Canada.

Like I said before, you need to carefully evaluate the choices you have in front of you and take the most appropriate judgement.

And sadly if you do meet your PR requirements but deliver outside Canada you or your husband will have to sponsor your babies inside Canada and it is often a challenge to get TRVs for the babies to accompany you. I have seen this on the forum before. TRV denied on basis the children would not leave Canada at the end of the visa. I think TRPermit is the only way to do it and I don't know how long that takes or percentage of success.
 
Contact CIC, explain your situation and see if they give you extension. Taking risk with flying while pregnant against doctor's advise might be fatal. Usually first 3 months and 7th month onwards are where doctors dont advise to fly. Not sure about your case though.

Consult the doctor long and hard on why he thinks it would be dangerous for you to fly, and try your best to mitigate the problem. At the same time, contact CIC as soon as you possibly can to ask them for extension (or potential resolution to this problem). I wish you good luck, and let us all hope the people at CIC are compassionate enough to at least grant you an extension.

If I'm not mistaken, you have to be in Canada to sponsor if you are a PR, so if they grant her an extension, then she can alone go to Canada to land, while leaving her husband in China with the two kids, or she and her husband can go to Canada (leaving the kids with relatives for several days), then have one of them go back immediately after landing, while the other one can sponsor the twins. The choice is obviously hers, but in my opinion, they have to prioritize the safety and well being of their kids above their visas.
 
You need to be in Canada for sponsoring PR.

If CIC comes to know that she was pregnant and did not inform them, it could be a problem later when she wants to sponser her kids. I would suggest going the right way and find out a solution. At CIC, they are human beings and would understand the situation. Additionally while contacting CIC, add medical doctor's note about the recommendation of not flying. It would certainly help if they indeed given an extension for such cases.

But if the doctor says it is okay to fly, the case is clear and no further discussion or argument is needed.
