Please help! SOWP holder staying in Canada if Spouse is not in Canada

Hello Experts,

I am on closed work permit currently and my wife is on spousal open work permit. My project is ramping down and any time I may have to go back to India. Our work permits are valid for next one year. Can my wife stay and work even though I am not in Canada until her SOWP expires?

I tried to search up information on this particular case at canada.ca but haven’t got any luck yet. So I would appreciate if anyone can share your experience or any lead on this whole process. Please help! I would really appreciate any input. Thank you!!

If her permit is valid, she can work until expiry.

Technically fine but does not look great since SOWP is awarded for family reunification purposes. Your wife appears to be trying to qualify for PR. Depending on her NOC and CRS that could mean a much longer period of separation for your family. It will be important to show IRCC that you remain in a relationship during the separation period including visiting each other.
