Hey guys, just an update:
- I called CIC this morning and they mentioned that it is ok that I keep on working until I get a response regarding my work permit application extension.
- They said if I do get it rejected for incompleteness then if I'm still within the 90 day period from the date of my status expiry, then I can apply to restore my status with a LOE.
- If I don't get a response for my work permit ext. application within 90 days after my status ends, then I can still apply for a restoration with an LOE stating why I'm applying for a restoration although my first application hasn't been decided upon.
- I really wish they gave me this in writing, I'm going to call them again to confirm the same with another agent just to be sure.

Hi there,

My current PGWP ends on August 4, 2016 and i've applied for an extension along with an open work permit. I don't have an LMIA and am not eligible for a PGWP extension. I haven't applied for PR yet as my score is currently 463 on express entry and have not received a notification of interest for PNP as going by the threads on this site CIC and OINP is currently clearing out backlogs.

My question is whether it is okay to continue working under implied status until i get a rejection for my work permit extension application, which is likely around October/November, bearing in mind that I applied for it 30 days before August 4 (the end of my current status)?

Recently a friend of mine stated that i cannot continue to work if i am not eligible for the work permit extension and that it may hinder my PR application (when i do apply for it, hoping soon once the invites go back up).
Another friend stated that it is okay for me to continue working until i get a rejection on my work permit application which is when i can apply for a restoration of status along with a visitor visa to continue living in the country until my PR application decision is made (again, hoping i'd have applied for it by then).

Any suggestions or opinions would be great, thanks guys!

Since you are not eligible for the permits you applied for I personally believe that you are not on implied status and should stop working.

Your application will be rejected and you will be asked to leave.

When I called, they just said they have everything they need for that application, which is weird as it implies "completeness". Nobody actually knows until they give a response.

Update: I got my REFUSAL today. They said my temporary resident status ended as of August 5, 2016. This clearly means it was NOT considered incomplete.

Hi guys I was on a closed work permit which is expired now and I already applied for student permit, what is my status at the moment ??

Please do not hijack threads like this. Start a new thread and elaborate your situation a bit more than just what you wrote.

hey did you have a complete application means did you have ITA or PNP on hand??

Did you get 90 days restoration period starting today then? or you got notice to leave? Pleasee tell me as i am in the same boat

I did not have ITA or PNP on hand at all. I just had an express entry profile.

I do have the option of restoring my status, although they don't specify the time of 90 days, but they wrote

"Please consult the section “Restoration of status” in the application guide: “Applying to change conditions or extend your stay in Canada”. Restoration applies to each member who has lost his or her status. Please note that there is no guarantee your application will be accepted."

So, siriusnick is right, let's not get so definitive that it WILL be incomplete and nobody will benefit from implied status. I will now take corrective measures to get myself back to a visitor status.

True - VO decisions vary, esp. when the rule has recently been changed. "May or may not" be returned as incomplete doesn't help much, though. It's helpful to have more people like you post their experience -

Good luck!

Thank you jes_ON. I will write a LOE and send in the restoration application early next week. This was stressful as hell. I am at 461 points in Express Entry.

are you restoring as student or visitor

I'm in the same boat status expired!!

Then why are you not restoring your status? Do you want to restore it or leave the country?

I wanna restore as student
