Can anybody tell why is so impossible to have LMIA from the employer??As I am working for the company but I am not sure which kind of difficulties can my employer face while applying for LMIA...I got the information here that its free for PR application so what the big deal for Employers?

If your employer is willing to do it and your job is eligible to get a positive LMIA, that's great... For me it is almost impossible because since I am a recent graduate with short experience, I am not getting the median (or higher) wage of my NOC code.

It is not so much about employer application. The problem is with HRDC. HRDC decides if the company is allowed to hire a foreigner instead of a local guy.
For a company (employer) it is almost impossible to prove that nowhere in Canada there is a required specialist (in NOC 0,A,B occupation) Canadian citizen or PR.

Can HRDC also reject the request of LMIA? by saying this that Employer dint hire the Canadian guy.

@ ee2015...I M also a fresh graduate here although I have some experience from backhome and almost 8 months co.op experience but I dint get your point about wage?

Why not? HRDC decides on LMIA. Nobody else. If you would like to know the HRDC rules for an employer to apply for LMIA- check on www.cic.ca.

I dint get your point about wage?
There is an "average" wage that HRDC expects you to get in the particular occupation. If it is lower then your occupation does not fit the requirements for LMIA.

1. If you are a CEC applicant living and working in Canada, the only thing that changes for you is the way you apply. Before you sent a list of things and we would assess it and then decide to give you PR or not. She said if you got a PR before EE under CEC, you will get it now. Terms for eligibility and certainty has not been changed. 2. The 600 points for LMIA just guarantees PR. This was the case before EE also. EE was just put in place to weed out applicants who try to take advantage of loopholes that makes the process slower.

3. Information is very incomplete and things might change after january/february. Rules were not put in place to detriment the PGWP or FSW, it was meant to bring in more talent thats why the cap was increased.


That is good info and was worth the god damned 20 mins on the wait line. This is all the info she gave me. Maybe things change in the future.

Even before EE ,If you have an LMIA in a skilled job or PNP ,Your PR is almost confirmed .The same thing is happening even in EE .

They just process PR applications according to the highest points in the pool per category instead of first come first serve (Thats It!)

As they have also increased cap , we all should be good.

As far as I know, you need to get the median or higher level of wage in the pay range for that specific NOC code to be eligible for LMIA. That information is available on Job Bank website. The median wage would be usually too high for fresh graduates to get without a good length of work experience.

Employers hiring foreign workers through the International Mobility Program do not need an LMIA. These people need a work permit but do not need an LMIA:

International Mobility Program
This program allows employers to hire or bring in foreign workers without the need of a Labour Market Impact Assessment (LMIA). Exemptions from the LMIA process are available where there are reciprocal benefits for Canadians and other competitive advantages for Canada.
Examples of individuals who come to Canada under an LMIA-exempt program include: international students who have graduated from a Canadian school; persons authorized to work in Canada temporarily due to free trade agreements, such as NAFTA, International Experience Canada participants, some permanent resident (PR) applicants settling in Canada while their PR application is finalized, and spouses of highly-skilled foreign workers.
