PGWP and SOWP

Hi all,

I'm an international student who has finished a post-graduate program. I'm waiting for the official documents from the College to apply for my PGWP and then, my husband can apply for an extension of his open work permit. I know that we need that I have a job NOC 0, A or B and 3 paystubs. I have been offered for a job position in a NOC B starting in January, but the company is outside Canada and I'll work remotely for them. I have been reading on the official website but haven't been able to find information if the company should a Canadian one for my husband to apply for his OPW. I assume that my employer should be a Canadian company but still would like to know.

Others can comment/correct as well given this is my interpretation as well that it seems implied the employer should be a Canadian employer so an employer with no presence in Canada would not count.

Note also assuming if it would count then working remotely for an employer outside of Canada would be doubtful to count as Canadian work experience , something to keep in mind for PR.

As said above only my personal view.

It needs to be a job in Canada. Your husband will have to apply to change his status to visitor.

Thank you so much for your responses. That's also my understanding.

One last question regarding my husband's status. We have an agency back home helping us to do some paperwork but based on previous experiences with them..I'm double-checking everything. I've asked them the question about the visitor record for my husband and the application 30 days earlier before this SOWP expires (30Mar2020) if I don't have the job and payslips by then. They have replied that it is not applicable and he needs to go outside Canada and re-enter again (my husband has also a visitor visa), then he can travel outside the country but it is really required?

I think the visitor record is applicable for him noting that I'm here working under my PGWP and our son is also here and he will take care of him during this time.

Is it possible to get a Statutory Declaration for Common Law here in Canada even if he is in the Philippines?

After applying, primary applicant's passport has been renewed.
Can we submit a webform mentioning the same ?
Also for SOWP extension, while submitting we only had primary applicant's job offer without any pay stubs.
But now we have 3 pay stubs.
Should we raise 2 separate web forms to inform ircc about these changes ? Or just 1 ?

Yes you can add the pay stubs via webform but since you didn’t qualify to apply when you did your application could be denied. You shouldn’t have applied given you didn’t meet the requirements.

I called the IRCC before applying and they said we can submit the paystubs via web form

Status update : Application approved.
My wife(primary applicant) applied for PGWP and SOWP extension together.
She had a NOC A job at the time of applying but did not have 3 pay checks.
We submitted 3 pay checks, 28 days later via web form.
Her employment letter was only for 3 months.

Both our visas were approved today.
Applied on 11th Sep
Approved on 9th December.

Primary applicant's Original Study permit validity : 18th Nov 2020
Secondary applicant's original OWP validity : 30th Sep 2020.

Because we applied before 30th sep, both of us were under implied status and were able to work.
