Hello,

My spouse and I have just been granted our Permanent non-conditional residency visas. We have been in a common-law relationship for 9 years. I am the principal applicant. We are still living in the UK.

However, we are in the process of breaking up. On the Confirmation of Permanent Residence form we have received it states "Your documents are only valid if all family members have been declared and examined. You must therefore inform us of any change in your martial status BEFORE you leave for Canada. We will let you know what further procedures are required".

Does anyone know what these further procedures are and how this could affect my Permanent Residency status now that the visa has been issued?

Any advice would be appreciated.

Thanks

What class was this granted under? I'm not sure that it will affect your PR if you went through a points system as I think you get more points for being single. I assume that's it for your spouse's visa though, if he/she was only listed as your spouse.

I believe you actually get more points for a spouse so that could change your eligibility. If you want to do things by the book, you would tell them that the relationship has broken down and that you are landing alone. If they want to revisit your eligibility because of that, so be it. Your partner would probably lose her visa.

However, my opinion is that you should just leave it alone, go ahead and land. Maybe you are just going through a rough patch so you go there with the mindset that you are landing now and she may follow you later, then nobody can tell you that you are doing anything wrong. Since it's a common law partnership, it's not like there's any official "divorce" document that somebody can throw in your face later and tell you that you landed without declaring your "divorce".
