I uploaded my ultrason baby records through the IRCC WEB FORM but the agent strangely told me that I'm not a representative. Why would I need to add representative since it's my application?? I don't want to use representative as I'm sponsor. I don't understand this .. Here's what they wrote :

Yes... I got this too. Our lawyer said my name is not needed. Whennreading through the application guides, stated full well that as a sponsor if I want access , I should fillmin the authorization form as well.

Hi.. i was wondering if anyone knew , how long it takes CBSA to verify the seized passport to CIC. We submitted proof to CIC about the seized passport along with a letter of explanation. But its been almost 2 months. When i called cic. They said they have not received any reply by cbsa yet. I dont want to call cbsa, but thats all cic is waiting for. On our on line acct it says 40 days left.. so maybe you can understand my frustration and just want this to be over

Down in the process, they will ask him to provide a valid passport, by then, he must write a letter stating why he doesn’t have his passport and invlude a copy of the original copy they gave him when they seized his passport, with the letter and just upload it through WebForm.

I will share with you the exemption letter they sent me which I had to bring with me to the landing interview to show the officer when she/he asks for my passport. The letter as follows:

This refers to the Application for Permanent Residence you made under the Spouse or

Common-Law Partner in Canada Class.

According to subsection 50(1) of the Immigration and Refugee Protection Regulations, a foreign

national seeking to become a permanent resident must hold

a) a passport, other than a diplomatic, official or similar passport, that was issued by the country of which the foreign national is a citizen or national;

b) a travel document that was issued by the country of which the foreign national is a citizen or national;

c) an identity or travel document that was issued by a country to non-national residents, refugees or stateless persons who are unable to obtain a passport or other travel document from their country of citizenship or nationality or who have no country of citizenship or nationality;

d) a travel document that was issued by the International Committee of the Red Cross in Geneva, Switzerland, to enable and facilitate emigration;

e) a passport or travel document that was issued by the Palestinian Authority;

f) an exit visa that was issued by the Government of the Union of Soviet Socialist Republics to its citizens who were compelled to relinquish their Soviet nationality in order to emigrate from that country;

g) a passport issued by the United Kingdom to a British National (Overseas), as a person born, naturalized or registered in Hong Kong;

h) a passport issued by the Hong Kong Special Administrative Region of the People’s Republic of China; or

i) a passport issued by the United Kingdom to a British Subject.

As per subsection 72(1)(e)(ii) of the Regulations, a foreign national in Canada becomes a permanent resident if, following an examination, it is established that except in the case of a foreign national who has submitted a document accepted under subsection 178(2) or of a member of the protected temporary residents class, they hold a document described in any of paragraphs 50(1)(a) to (h).

After careful consideration of the circumstances in your case, I hereby grant you an exemption from subsections 50(1) and 72(1)(e)(ii) of the Immigration and Refugee Protection Regulations. Your application will continue to be processed without the requirement of a valid passport or travel document.

Should your application for permanent residence be approved, you must bring this letter along with other original documents (i.e. birth certificate) which will establish your identity to your landing appointment.

Yes they granted me PR without a valid passport, now that I am a PR, I applied for a Refugee Travel Document (RTD) and they issued me that without any problems, I have RTD valid for 5 years.

*I forgot to tell you something, if he was accepted as a protected person, he should include his Notice of Decision with the letter he will write besides the copy of his seized passport.
So if he accepted as protected person then why he applied for sponsorship

For context, my partner has applied for PR EE-CEC, but his passport is seized and expired by CBSA. We got a request for a valid passport and plan to submit an explanation with the CBSA seizure letter and certified copy of the seized passport. We also got a biometrics letter, but we are not sure if they will let him give biometrics without a valid passport. I have not been able to find any information on this.

Why was his passport seized? If his asylum claim was denied his time working in Canada would not count for CEC.

It was seized due to a non enforceable exclusion order - due to working (a few hours!!!) out of status (really minor). It's 1.5 old and never been enforced. He never claimed asylum, he actually passed eligibility for PR EE-CEC according to GCMS notes.
