Hey guys, i have a question, maybe its obvious, but im really not familiar with the rules for parental sponsorship.

Once my spouse gets his permanent residence and once the hold on family sponsorships is lifted.
We are planning to sponsor my spouses mother and younger brother as a dependent,
Im just wondering...

His mother is married, but we are not planning to sponsor her husband(my spouses step dad) they dont really get along-long story. Anyways even though she is married, is it possible to sponsor her without having to include her husband in the sponsorship. Pretty much leave him out all together, without them actually having to get a divorce or anything.

Any help would be appreciated

Hey Leisa,

This topic seems to pop up a lot. Logistically speaking this is very difficult. First off your spouse will have to fulfill I believe 5 years before he can sponsor anybody. Then even if the parental sponsorship opens up again the wait times are horrendous, last time I checked I believe it was around 5 or 6 years. You are looking at about 11 years from now if your husband was to sponsor his mum. Unfortunately sponsoring parents is not really much of a goer unless you are already eligible to sponsor them. I maybe slightly wrong with about 11 years total but it will be somewhere near that mark.

As for the brother unless he was an orphan then he can't sponsor him. The mother could sponsor him once she has PR but then add a further 5 years + processing times and you will be looking at 20+years providing he is still a dependant. Super visa is about as good as it gets in reality unless you qualify to sponsor your parents relatively soon because the processing and wait times are so long.

My husband will become a citizen after about 2 years.
So i think that doesnt apply, unless he stays PR. But he lived in Canada legally before which counts towards his citizenship.

And also i should be clear, the brother is a dependent of his mother, and he will be a dependent for a few more years.


All i really want to know. is if his mother can be sponsored without having to include her husband?
 
You cannot sponsor siblings unless they are orphans. Since his mother is still alive, then no your spouse cannot sponsor him.

okay. well than he will come as a student which is the other option anyways

I didnt see the links before, but yes i know the approx processing time, Although the new reform is coming out in april. so I guess we should wait and see what changes cic has made to the rules and procedures etc.

soo in other words you dont know the answer to my initial question about leaving the husband out ?

I certainly don't know this for sure but he could very well in theory sponsor his Mother and leave his step dad out. She obviously would have to comply and fill her paperwork out in the appropriate way that would make him ineligible from joining her. I think CIC would scrutinise this application because it would seperate the couple and it would separate the brother from his mother unless obviously he was here under another class.

There are many people who are sponsoring a parent and dependent children who contribute to the thread PARENT SPONSORSHIP JOINE HERE on this forum. You may find an answer to your specific question by posting in that thread if you don't get an answer otherwise.
The issue of what happens after November 2013, when the 2 year halt on parent applications is over, is debatable,no one knows what the rules will be then. However, if it resumes ,the processing times should hopefully be shorter. The 31 to 55 months relates to the cases in process at the moment (sept 2007 to nov 2009 cases) . Dec 2009 to Nov 2011 will be the next batch to be hopefully cleared by Nov 2013.

Yes, the processing times are very long, but hopefully with the new changes, they find a way to shorter it a bit at least.
