Out of Canada for 4 out of 5 years, card still valid.

Hello Friends,

Warm greetings.

I am from Bangalore, India and did landing with my family on March 2015 and now planning to go with family to Canada for settlement.

What will be situation now? Will we be reported or there is fair chance to let us in?

Frankly, there is no justification for delay in our case, not able to find job (already was in high paying job at Bangalore itself of about 10,000 CAD) was the primary reason.

The card is still valid though for another 1 year till Match 2020.

Please help suggest.

You will be allowed in but no one here can tell you if you will be reported or not. Chances to be reported are high because there is no way you can complete your residency obligations.

Thanks jddd, agreed, they have all right to report and is by law, but in general asking, if this is lenient or strictly enforced?

As jddd said nobody here can predict whether you will be reported or not. Maybe you will not be asked the question how long you have been away .

With CBSA the advice is always to only answer questions asked honestly but do not volunteer extra information.

If you enter successfully you will need to stay put for at least 2 years with no interaction with IRCC and if you do think of it as having won a lottery after so long away. If you are reported you will be allowed in and have the chance to appeal.

So the answer is you are allowed in but you may get reported, if you get reported, you will loose your PR but having chance to appeal. for all this period, you are able to stay in Canada? once you fail appeal, you have to leave, is that correct?
How long do you think this process going to be?
