Hi Friends,

I am looking for Open WP or LMIA immediately as my Employer asked me to go back to my country in few weeks. Please let me know if there is any option to get Open WP or LMIA.

I am currently on ICT Visa valid till Feb 2016

Thank you
R~

Your employer asked you to go back to your country? Sorry, but is he the king of Canada? ;D Get a visitor's visa, if nothing else works.

If you applied under CEC, then apply for a Bridging Open Work Permit. LMIA can only be acquired by your employer. The Open Work Permit is something you can apply for yourself.

If Money is not concern take study permit on spouse name & based on that take open work permit.

You can apply for employments Insurance if EI was deducted from your salary for at least 11 months, this would not be big amount (around $1500/month) but will help you.

Best of Luck.

It's too late to apply for a study permit for the January term. The earliest his spouse could start classes is May.

You don't qualify for an open work permit.

To obtain a new closed work permit you will have to find a new employer who is willing to offer you a full time job and who can obtain an LMIA. This tends to be very difficult to do.

Your employer has no authority to tell you to to leave Canada or go back to your country. They can only say that your services are no longer required.

However, the expiry of your ICT visa does require you to leave soon, unless you find another way to stay.

As others have suggested, you could apply for a visitor's visa, if you can afford to stay in Canada without working - it might give you more time to look for another job.

Thank you friends, it will be really helpful If I can find a way to stay back. Visitor visa is the worst case scenario I am thinking of.
Please keep posting all the options / possibilities which is going to help me and family.

Depending on what country you are from, you might be able to apply for another ICT visa.

I think you are confusing ICT (intra company transfer) visas with IEC (working holiday) visas. Individuals cannot apply for an ICT visa on their own - this is something your company must apply for since it's an intra company transfer (transfer from within your own company). The OP cannot apply for and does not qualify for another ICT. To qualify, he would have to return to his home country, start working for another company there and remain in that role for a while, and then later have that company transfer him to Canada via a new ICT.

If he wants to remain in Canada and work, he needs to find a company willing to go through the LMIA process.

I am planning to apply for Visitor Visa. Can I stay back in the country in applied status or I should get the Visitor Visa only then I can stay back ? Please help.

You can stay until you get a response, but you will not have "implied status," you won't be able to work (since you are changing the type of permit from worker to visitor).
